Property and casualty insurers must supplement inconclusive aerial images with on-site inspections or other reliable sources, as images older than 24 months are inappropriate for decisions impacting consumers. Aerial images showing only cosmetic damage such as discoloration or streaking cannot support non-renewals without confirmation of material damage, and insurers must provide copies of images to insureds upon request during disputes regarding non-renewals, cancellations, or claim settlements. Requirements for on-site inspections are waived for claims investigations following extreme weather events when property access is limited, and insurers must conduct reasonable investigations based on all available information under 8 V.S.A. § 4724, Regulation 79-2, and Regulation 99-1.
