Memo 1995-5 Use of Word Bank in a Corporation Name
Staff Attorney Sonya Allen issues guidance interpreting Kansas statute K.S.A. 9-2011 to prohibit unauthorized entities from using the word "bank" in their corporate names. The department asserts that such usage deceptively implies regulatory supervision and banking authority, thereby misleading consumers about the entity's financial status. Consequently, the department will evaluate each case individually based on service types, public contact, and consumer sophistication to determine if the name creates a likelihood of confusion.
