CONCERNING
REPORTING BY COMMERCIAL BANKS VIA THE FINANCIAL SERVICES AUTHORITY REPORTING SYSTEM
BY THE GRACE OF GOD THE ALMIGHTY,
THE COMMISSIONERS OF THE FINANCIAL SERVICES AUTHORITY,
Considering:
a. that in the context of banking sector supervision, the Financial Services Authority (OJK) has developed a reporting system as a means to obtain comprehensive, complete, accurate, up-to-date, holistic, and timely information on the financial condition and business activities of banks; b. that to improve the effectiveness and efficiency of report submission by banks and to enhance technology-based supervision, simplification and digitalization are necessary for reports submitted to the Financial Services Authority, thereby necessitating the replacement of the Financial Services Authority Regulation Number 63/POJK.03/2020 concerning Reporting by Commercial Banks via the Financial Services Authority Reporting System;
c. that based on the considerations referred to in letters a and b, it is necessary to establish a Financial Services Authority Regulation concerning Reporting by Commercial Banks via the Financial Services Authority Reporting System;
Recalling:
DECIDING:
To establish:
A FINANCIAL SERVICES AUTHORITY REGULATION CONCERNING REPORTING BY COMMERCIAL BANKS VIA THE FINANCIAL SERVICES AUTHORITY REPORTING SYSTEM.
CHAPTER I
GENERAL PROVISIONS
Article 1
In this Financial Services Authority Regulation, the following terms are defined as:
Article 2
(1) Banks and KPBLN compile and submit Reports to the Financial Services Authority that are complete, accurate, up-to-date, holistic, and timely.
(2) Banks and KPBLN submit Reports as referred to in paragraph (1) to the Financial Services Authority online via the Financial Services Authority Reporting System.
(3) In the event of errors in data and/or information in the Report as referred to in paragraph (2), Banks and KPBLN compile and submit Report corrections online via the Financial Services Authority Reporting System.
Article 3
Reports as referred to in Article 2 paragraph (1) consist of:
a. Periodic Reports; and b. Incidental Reports.
CHAPTER II
REPORTING RESPONSIBILITY
Article 4
(1) Banks and KPBLN appoint a reporting officer to the Financial Services Authority.
(2) The reporting officer as referred to in paragraph (1) is a permanent employee of the Bank and KPBLN tasked with performing:
a. verification and submission of Reports via the Financial Services Authority Reporting System; and b. administration and management of access rights for reporting officers on the Financial Services Authority Reporting System. (3) The reporting officer as referred to in paragraph (1) may appoint reporting staff.
Article 5
(1) The appointment of the reporting officer as referred to in Article 4 paragraph (1) or any changes thereto shall be submitted via letter to the Financial Services Authority.
(2) The letter of appointment or change of reporting officer as referred to in paragraph (1) shall be signed by:
a. one of the members of the Board of Directors or an official appointed by the Board of Directors, for Banks; or b. the Head of the KPBLN or an official appointed by the Head of the KPBLN, for KPBLN.
(3) The letter of appointment or change of reporting officer as referred to in paragraph (1) shall contain at least:
a. name; b. position;
c. population identity number of the appointed reporting officer; and
d. email address reflecting the identity of the Bank and KPBLN.
(4) The format of the letter of appointment or change of reporting officer as referred to in paragraph (1) shall be determined by the Financial Services Authority.
CHAPTER III
PERIODIC REPORTS
Article 6
(1) Periodic Reports as referred to in Article 3 letter a consist of Reports with data positions:
a. daily; b. monthly;
c. quarterly;
d. semi-annually; and e. annually.
(2) Periodic Reports as referred to in paragraph (1) contain groups of information including:
a. financial information; b. risk and capital information;
c. product, activity, and business information; and
d. basic data information.
Article 7
Banks are required to submit daily Periodic Reports as referred to in Article 6 paragraph (1) letter a no later than the end of the next working day.
Article 8
Banks are required to submit monthly Periodic Reports as referred to in Article 6 paragraph (1) letter b with the following provisions:
a. Period I, the Report is submitted no later than the 7th of the following month; b. Period II, the Report is submitted no later than the 15th of the following month;
c. Period III, the Report is submitted no later than the 21st of the following month; and
d. Period IV, the Report is submitted no later than the last day of the following month.
Article 9
Banks and KPBLN are required to submit quarterly Periodic Reports as referred to in Article 6 paragraph (1) letter c with the following provisions:
a. Period I, the Report is submitted no later than the date:
Article 10
Banks are required to submit semi-annual Periodic Reports as referred to in Article 6 paragraph (1) letter d with the following provisions:
a. Period I, the Report is submitted no later than the date:
Article 11
(1) Banks and KPBLN are required to submit annual Periodic Reports as referred to in Article 6 paragraph (1) letter e in the form of a work plan with the following provisions:
a. Period I, the Report is submitted no later than October 31 before the year of the work plan; and b. Period II, the Report is submitted no later than November 30 before the year of the work plan.
(2) Banks are required to submit annual Periodic Reports other than the work plan as referred to in paragraph (1) with the following provisions for:
a. Period III, the Report is submitted no later than January 21 of the following year; b. Period IV, the Report is submitted no later than January 31 of the following year; and
c. Period V, the Report is submitted no later than April 30 of the following year.
(3) Banks that do not submit updates of the recovery action plan until the submission deadline as referred to in paragraph (1) shall be subject to administrative sanctions in accordance with the Financial Services Authority Regulation concerning the determination of supervisory status and handling of commercial bank issues.
Article 12
Banks and KPBLN are required to submit information in Periodic Reports as referred to in Article 7, Article 8, Article 9, Article 10, Article 11 paragraph (1), and/or paragraph (2) completely and accurately.
Article 13
Provisions regarding the details of Periodic Reports for each submission period shall be determined by the Financial Services Authority.
Article 14
(1) Banks and KPBLN that do not submit Periodic Reports until the submission deadline as referred to in Article 7, Article 8, Article 9, Article 10, Article 11 paragraph (1), and/or paragraph (2) shall be subject to administrative sanctions in the form of a fine of IDR 1,000,000.00 (one million rupiah) per working day and a maximum of IDR 30,000,000.00 (thirty million rupiah) per Report. (2) Banks and KPBLN that do not submit information completely and accurately as referred to in Article 12 based on findings by the Bank, KPBLN, or the Financial Services Authority shall be subject to administrative sanctions in the form of a fine of IDR 100,000.00 (one hundred thousand rupiah) per entry error and a maximum of IDR 10,000,000.00 (ten million rupiah) per Report. (3) In the event that the submission of information in Periodic Reports is incomplete and inaccurate as referred to in paragraph (2), resulting in other entry errors in:
a. the same Report; and/or b. other Reports, administrative sanctions in the form of fines shall not be imposed on other entry errors in the same Report and/or other Reports.
(4) Banks and KPBLN that have been subject to administrative sanctions in the form of fines as referred to in paragraph (1) and paragraph (2) remain obligated to submit Reports and/or Report corrections.
(5) Banks and KPBLN that do not fulfill the provisions as referred to in paragraph (4) shall be subject to administrative sanctions in the form of a written reprimand.
(6) In the event that Banks and KPBLN have been subject to administrative sanctions as referred to in paragraph (5) and continue to violate the provisions as referred to in paragraph (4), Banks and KPBLN may be subject to administrative sanctions in the form of:
a. suspension of certain business activities; b. prohibition on issuing products or conducting new activities; and/or
c. downgrade of the governance factor rating in the Bank's health level assessment.
(7) In the event that the Board of Directors, Board of Commissioners, Sharia Supervisory Board, and/or executive officials of the Bank or the Head of the KPBLN violate the provisions as referred to in paragraph (4), they may be subject to administrative sanctions in the form of prohibition as a principal party in accordance with the Financial Services Authority Regulation concerning re-evaluation of principal parties of financial service institutions.
Article 15
In the event that Banks and KPBLN:
a. correct Periodic Reports based on audit results by a public accountant registered with the Financial Services Authority; and/or b. submit corrections to Periodic Reports before the final submission deadline as referred to in Article 7, Article 8, Article 9, Article 10, Article 11 paragraph (1), and/or paragraph (2), Banks and KPBLN are exempt from the imposition of administrative sanctions in the form of fines as referred to in Article 14 paragraph (2).
CHAPTER IV
INCIDENTAL REPORTS
Article 16
(1) Incidental Reports as referred to in Article 3 letter b must be submitted in accordance with the submission deadlines regulated in the provisions of legislation in the banking sector.
(2) Incidental Reports as referred to in paragraph (1) contain groups of information including:
a. supervisory information; b. institutional information;
c. business activity information; and
d. other information.
(3) Provisions regarding the details of Incidental Reports as referred to in paragraph (1) shall be determined by the Financial Services Authority.
Article 17
Banks and KPBLN are required to submit data and/or information in Incidental Reports as referred to in Article 16 paragraph (1) completely and accurately.
Article 18
(1) Banks and KPBLN that do not submit Incidental Reports until the submission deadline as referred to in Article 16 paragraph (1) shall be subject to administrative sanctions in accordance with the provisions of legislation in the banking sector. (2) In the event that the provisions of legislation in the banking sector do not establish administrative sanctions as referred to in paragraph (1), Banks and KPBLN that do not submit Incidental Reports after the final submission deadline as referred to in Article 16 paragraph (1) shall be subject to administrative sanctions in the form of a fine of IDR 1,000,000.00 (one million rupiah) per working day and a maximum of IDR 30,000,000.00 (thirty million rupiah) per Report. (3) Banks and KPBLN that do not submit data and/or information completely and accurately as referred to in Article 17 based on findings by the Bank, KPBLN, or the Financial Services Authority shall be subject to administrative sanctions in the form of a fine of IDR 100,000.00 (one hundred thousand rupiah) per data and/or information error and a maximum of IDR 10,000,000.00 (ten million rupiah) per Report. (4) Banks and KPBLN that have been subject to administrative sanctions in accordance with the provisions of legislation in the banking sector as referred to in paragraph (1) or administrative sanctions in the form of fines as referred to in paragraph (2) and paragraph (3) remain obligated to submit Reports and/or Report corrections. (5) Banks and KPBLN that do not fulfill the provisions as referred to in paragraph (4) shall be subject to administrative sanctions in the form of a written reprimand. (6) In the event that Banks and KPBLN have been subject to administrative sanctions as referred to in paragraph (5) and continue to violate the provisions as referred to in paragraph (4), Banks and KPBLN may be subject to administrative sanctions in the form of:
a. suspension of certain business activities; b. prohibition on issuing products or conducting new activities; and/or
c. downgrade of the governance factor rating in the Bank's health level assessment.
(7) In the event that the Board of Directors, Board of Commissioners, Sharia Supervisory Board, and/or executive officials of the Bank or the Head of the KPBLN violate the provisions as referred to in paragraph (4), they may be subject to administrative sanctions in the form of prohibition as a principal party in accordance with the Financial Services Authority Regulation concerning re-evaluation of principal parties of financial service institutions.
Article 19
In the event that Banks and KPBLN:
a. correct Incidental Reports based on audit results by a public accountant registered with the Financial Services Authority; and/or b. submit corrections to Incidental Reports before the final submission deadline as referred to in Article 16 paragraph (1), Banks and KPBLN are exempt from the imposition of administrative sanctions in the form of fines as referred to in Article 18 paragraph (3).
CHAPTER V
MERGING REPORTS IN PERIODIC REPORTS AND INCIDENTAL REPORTS
Article 20
(1) Banks submit:
a. Reports on the implementation plan of Bank products; and b. Reports on outsourcing plans, in the business plan.
(2) Banks submit:
a. Reports on the activity of agency for foreign financial products; b. Periodic bancassurance Reports;
c. Reports on outstanding transactions of structured products;
d. Reports on the appointment of foreign workers as experts or consultants; e. Reports on trust activities; f. Reports on problematic outsourcing; g. information on evidence of settlement of rights and obligations of regional offices, branch offices, and offices outside the country to customers and/or other parties in connection with the closure of regional offices, branch offices, and offices outside the country; and h. information on evidence of settlement of rights and obligations of sub-branch offices to customers and/or other parties in connection with the closure of sub-branch offices, in the Report on the realization of the business plan. (3) Banks submit Reports on the implementation of governance in the financial publication Report and annual financial performance information. (4) Banks submit the financial publication Report and annual financial performance information accompanied by a management letter. (5) Banks submit Reports on changes to the Board of Directors and/or Board of Commissioners from controlling shareholders of the Bank that are legal entities in the Report on the list of details of related parties.
Article 21
(1) BUKs submit:
a. Reports on the temporary relocation of the address of the network of offices of Indonesian legal entity banks; b. information on the temporary closure of offices of Indonesian legal entity banks other than the headquarters;
c. Reports on the temporary relocation of the address of the network of offices of branch offices of banks located outside the country; and
d. information on the temporary closure of the network of offices of branch offices of banks located outside the country other than branch offices of banks located outside the country, in the Report on temporary changes to the office network. (2) BUSs submit:
a. Reports on the temporary relocation of the address of the network of offices of Indonesian legal entity banks; and b. information on the temporary closure of offices of Indonesian legal entity banks other than the headquarters, in the Report on temporary changes to the office network. (3) UUSs submit:
a. Reports on the temporary relocation of the address of the network of offices of UUS; and b. information on the temporary closure of UUS offices, in the Report on temporary changes to the office network.
(4) BUKs and BUSs submit:
a. information on changes in the composition of share ownership of Indonesian legal entity banks recorded in the articles of association and not resulting in a change in control; b. information on changes in the composition of share ownership of Indonesian legal entity banks recorded in the articles of association caused by share gifts or inheritance and not resulting in a change in paid-up capital;
c. minutes of approval of the General Meeting of Shareholders and changes to the articles of association approving the relocation of the headquarters address that results in a change in domicile; and
d. minutes of approval of the General Meeting of Shareholders and changes to the articles of association approving the cancellation of the relocation of the headquarters address that results in a change in domicile, in the Report on changes to the articles of association.
CHAPTER VI
PROCEDURES FOR SUBMISSION OF REPORTS
Article 22
Banks and KPBLN are deemed to have submitted Reports on the date the Reports are received by the Financial Services Authority Reporting System.
Article 23
(1) In the event that the Financial Services Authority Reporting System experiences technical disturbances at the submission deadline for Reports, thereby preventing Banks and KPBLN from submitting Reports, the Financial Services Authority shall notify Banks and KPBLN of the technical disturbance in writing, delivered:
a. directly to Banks and KPBLN; b. via the Financial Services Authority Reporting System;
c. via electronic media; and/or
d. other media.
(2) Banks and KPBLN submit Reports no later than 1 (one) working day after the Financial Services Authority notifies that the technical disturbance at the Financial Services Authority as referred to in paragraph (1) has been resolved.
Article 24
(1) In the event that Banks and KPBLN experience force majeure circumstances such that they cannot submit Reports and/or Report corrections until the submission deadline, Banks and KPBLN shall notify the Financial Services Authority in writing to obtain a postponement of the submission deadline for Reports and/or Report corrections. (2) The submission of the notification letter as referred to in paragraph (1) is done offline to:
a. the supervision department of the relevant Bank or the Financial Services Authority office in Jakarta for Banks with headquarters or branch offices of banks located outside the country located in the Special Capital Region of Jakarta and KPBLN; or b. the local Financial Services Authority office according to the region of the Bank's headquarters location, for Banks with offices outside the Special Capital Region of Jakarta. (3) Banks and KPBLN that obtain a postponement of the deadline as referred to in paragraph (1)
submit Reports and/or Report corrections after the Bank and Foreign Bank Branch resume normal operational activities.
(4) Postponement of the deadline for submitting Reports and/or Report corrections is only granted until the force majeure situation has been resolved or based on the consideration of the Financial Services Authority.
(5) The imposition of administrative sanctions as referred to in Article 14 paragraph (1), Article 18 paragraph (1), and/or paragraph (2) is excluded for Banks and Foreign Bank Branches experiencing force majeure as referred to in paragraph (1).
Article 25
(1) In the event of damage to Reports and/or Report corrections due to technical disturbances or other disturbances in the Financial Services Authority Reporting System, the Financial Services Authority may request the Bank and Foreign Bank Branch to resubmit the Reports and/or Report corrections. (2) Banks and Foreign Bank Branches resubmit Reports and/or Report corrections upon request from the Financial Services Authority as referred to in paragraph (1).
Article 26
If the deadline for submitting Reports falls on a Saturday, Sunday, and/or other public holiday, the Reports are submitted on the next working day.
CHAPTER VII
OTHER PROVISIONS
Article 27
(1) Submission obligations:
a. Periodic Reports as referred to in Article 3 letter a; and b. Incidental Reports as referred to in Article 3 letter b, are initially established by the Financial Services Authority based on this Financial Services Authority Regulation. (2) In the event that the Financial Services Authority Reporting System is not yet available for Reports in accordance with this Financial Services Authority Regulation, provisions regarding the submission of Reports, including the imposition of sanctions and submission deadlines, refer to Financial Services Authority Regulation Number 63/POJK.03/2020 concerning Reporting by Commercial Banks via the Financial Services Authority Reporting System.
Article 28
In the event that the obligation to submit Reports via the Financial Services Authority Reporting System is established in Financial Services Authority regulations, the submission deadline, submission procedures, and imposition of administrative sanctions are implemented in accordance with this Financial Services Authority Regulation.
Article 29
(1) For Banks and Foreign Bank Branches that are newly established or have just been granted permission to open, the obligation to submit Reports via the Financial Services Authority Reporting System is first carried out for data positions 1 (one) month after the Bank and Foreign Bank Branch conduct operational activities. (2) In the event that a Bank undergoes merger, consolidation, separation, integration, conversion, change of business activities from Foreign Currency Bank to Commercial Bank, or is a newly established intermediary bank, the adjustment of the obligation to submit Reports online is established by the Financial Services Authority.
Article 30
The Financial Services Authority may establish policies different from this Financial Services Authority Regulation based on specific considerations.
CHAPTER VIII
TRANSITIONAL PROVISIONS
Article 31
At the time this Financial Services Authority Regulation comes into force, Banks and Foreign Bank Branches that commit violations regarding Reporting by Commercial Banks via the Financial Services Authority Reporting System prior to the effectiveness of this Financial Services Authority Regulation, examinations, decisions, and imposition of sanctions for such violations are based on Financial Services Authority Regulation Number 63/POJK.03/2020 concerning Reporting by Commercial Banks via the Financial Services Authority Reporting System.
CHAPTER IX
CLOSING PROVISIONS
Article 32
At the time this Financial Services Authority Regulation comes into force, provisions regarding the submission of:
a. Reports on changes in the list of Bank branches that will conduct business activities in foreign currency as regulated in Financial Services Authority regulations regarding requirements for commercial banks to conduct business activities in foreign currency; b. Reports on the assessment of the application of risk management in insurance companies as regulated in Financial Services Authority Regulation Number 38/POJK.03/2017 concerning Consolidated Risk Management for Banks Controlling Subsidiary Companies (State Gazette of the Republic of Indonesia Year 2017 Number 144, Supplement to the State Gazette of the Republic of Indonesia Number 6087);
c. Reports on the updating of domicile data and information of principal parties and other contactable parties as regulated in Financial Services Authority Regulation Number 34/POJK.03/2018 concerning Re-evaluation of Principal Parties of Financial Service Institutions (State Gazette of the Republic of Indonesia Year 2018 Number 259, Supplement to the State Gazette of the Republic of Indonesia Number 6285);
d. Reports on credit restructuring and reports on differences in productive asset quality as regulated in Financial Services Authority Regulation Number 40/POJK.03/2019 concerning Assessment of Asset Quality of Commercial Banks (State Gazette of the Republic of Indonesia Year 2019 Number 247, Supplement to the State Gazette of the Republic of Indonesia Number 6440); e. Reports on financing restructuring and reports on differences in productive asset quality as regulated in Financial Services Authority Regulation Number 2/POJK.03/2022 concerning Assessment of Asset Quality of Sharia Commercial Banks and Sharia Business Units (State Gazette of the Republic of Indonesia Year 2022 Number 37, Supplement to the State Gazette of the Republic of Indonesia Number 6764); f. Reports on monitoring the largest write-off debtors, reports on follow-up for 15 (fifteen) largest nonperforming loans or nonperforming financings, and Reports on Indonesian banking human resources data monthly as regulated in the implementation provisions of Financial Services Authority Regulation Number 63/POJK.03/2020 concerning Reporting by Commercial Banks via the Financial Services Authority Reporting System (State Gazette of the Republic of Indonesia Year 2020 Number 297, Supplement to the State Gazette of the Republic of Indonesia Number 6604); g. Reports as regulated in Financial Services Authority Regulation Number 12/POJK.03/2021 concerning Commercial Banks (State Gazette of the Republic of Indonesia Year 2021 Number 163, Supplement to the State Gazette of the Republic of Indonesia Number 6700), namely:
Article 33
At the time this Financial Services Authority Regulation comes into force, all provisions that are the implementation of Financial Services Authority Regulation Number 63/POJK.03/2020 concerning Reporting by Commercial Banks via the Financial Services Authority Reporting System (State Gazette of the Republic of Indonesia Year 2020 Number 297, Supplement to the State Gazette of the Republic of Indonesia Number 6604) are declared to remain in force insofar as they do not conflict with the provisions in this Financial Services Authority Regulation.
Article 34
At the time this Financial Services Authority Regulation comes into force, Financial Services Authority Regulation Number 63/POJK.03/2020 concerning Reporting by Commercial Banks via the Financial Services Authority Reporting System (State Gazette of the Republic of Indonesia Year 2020 Number 297, Supplement to the State Gazette of the Republic of Indonesia Number 6604) is revoked and declared invalid.
Article 35
This Financial Services Authority Regulation comes into force on the date of its promulgation.

CONCERNING
REPORTING BY COMMERCIAL BANKS VIA THE FINANCIAL SERVICES AUTHORITY REPORTING SYSTEM
I. GENERAL
To support the supervisory function in the banking sector, information on the financial condition and business activities of Banks and Foreign Bank Branches is required. This information must be comprehensive, complete, accurate, up-to-date, whole, and timely. Banks and Foreign Bank Branches must compile and submit to the Financial Services Authority information on the financial condition and business activities of Banks and Foreign Bank Branches in the form and according to the time established by the Financial Services Authority in accordance with banking sector legislation provisions.
Currently, Banks and Foreign Bank Branches have submitted a series of Reports regarding information on the financial condition and business activities of Banks and Foreign Bank Branches to the Financial Services Authority. The information submitted needs to be focused by considering relevance and needs in the current supervisory process. In order to increase the effectiveness and efficiency of reporting by Banks and Foreign Bank Branches, simplification of Reports submitted to the Financial Services Authority is carried out.
In addition, in line with technological developments, efficient and fast online reporting methods are needed via the Financial Services Authority Reporting System and digitalization for Reports that are still submitted in printed document form. The change in the submission of Reports from printed documents to electronic-based aims to increase the effectiveness of the Financial Services Authority's supervisory function.
Generally, this Financial Services Authority Regulation contains main materials compiled systematically, including regarding the scope of Reports, Report periods, and submission procedures in the Financial Services Authority Reporting System.
