Amendments to the National Bank of Kazakhstan Board Resolutions No. 207 and No. 208

On amendments and additions to the Decision of the Board of the National Bank of the Republic of Kazakhstan dated August 31, 2016 No. 207 "On approval of the Rules for opening, maintaining and closing bank accounts of clients" and the Decision of the Board of the National Bank of the Republic of Kazakhstan dated August 31, 2016 No. 208 "On approval of the Rules for making non-cash payments and (or) money transfers within the territory of the Republic of Kazakhstan"

The Board of the National Bank of the Republic of Kazakhstan DECIDES:

1. Make the following amendments and additions to the Decision of the Board of the National Bank of the Republic of Kazakhstan dated August 31, 2016 No. 207 "On approval of the Rules for opening, maintaining and closing bank accounts of clients" (registered in the Registry of state registration of normative legal acts under No. 14422):

in the Rules for opening, maintaining and closing bank accounts of clients approved by said decision:

rephrase paragraph 11 as follows:

"11. When opening a bank account, an individual client submits an application indicating information about the non-conducting of operations related to entrepreneurial activity, activity within the framework of the special tax regime for self-employed persons, notarial activity, advocacy activity, activity for the execution of enforcement documents, activity for dispute resolution in mediation order, if such conditions are not provided for by the banking service agreement between the client and the bank.";

rephrase the sixth subparagraph of sub-item 3) of paragraph 26 as follows:

"permission of the central authorized body for budget execution in accordance with the Procedures for treasury execution of the budget and their cash servicing, procedures for treasury accounting and monitoring, approved by the Order of the Minister of Finance of the Republic of Kazakhstan dated June 27, 2025 No. 328 (for state institutions funded from the state budget);";

add paragraph 28-6 of the following content:

"28-6. When opening a current account by an individual for carrying out activity within the framework of the special tax regime for self-employed persons, the client (citizen, resident) provides to the bank:

document confirming identity;

application for opening an account for self-employed persons using the special tax regime in accordance with Chapter 77 of the Tax Code.".

2. Make the following addition to the Decision of the Board of the National Bank of the Republic of Kazakhstan dated August 31, 2016 No. 208 "On approval of the Rules for making non-cash payments and (or) money transfers within the territory of the Republic of Kazakhstan" (registered in the Registry of state registration of normative legal acts under No. 14419):

in the Rules for making non-cash payments and (or) money transfers within the territory of the Republic of Kazakhstan approved by said decision:

add paragraph 15-1 of the following content:

"15-1. In case of grant financing for projects on commercialization of results of scientific and (or) scientific and technical activities, payment from the current account in escrow account mode, opened in the name of the grant recipient, is carried out to the bank account of the counterparty (party to the contract) on the basis of the agreement between them.".

3. The Department of Payment Systems and Digital Financial Technologies of the National Bank of the Republic of Kazakhstan shall ensure in the manner established by the legislation of the Republic of Kazakhstan:

1) jointly with the Legal Department of the National Bank of the Republic of Kazakhstan the state registration of this Decision in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this Decision on the official Internet resource of the National Bank of the Republic of Kazakhstan after its official publication;

3) within ten working days after the state registration of this Decision, submission to the Legal Department of the National Bank of the Republic of Kazakhstan of information on the implementation of measures provided for in sub-item 2) of this paragraph.

4. Control over the implementation of this Decision shall be entrusted to the Deputy Chairman of the National Bank of the Republic of Kazakhstan overseeing this area.

5. This Decision shall enter into force upon the expiration of ten calendar days after the day of its first official publication.
