Resolution of the Board of the Central Bank of the Republic of Uzbekistan

On Amendments and Additions to the Instruction on Opening Bank Accounts in Banks of the Republic of Uzbekistan

This resolution has lost its force based on the Resolution of the Board of the Central Bank of the Republic of Uzbekistan dated January 4, 2023, No. 30/18 "On Approval of the Instruction on the Procedure for Opening, Maintaining, and Closing Bank Accounts" (registration number 3420, dated February 8, 2023).

In accordance with the Law of the Republic of Uzbekistan "On the Central Bank of the Republic of Uzbekistan" and the Resolution of the Cabinet of Ministers of the Republic of Uzbekistan No. 66 dated February 9, 2017 "On Measures to Implement the Resolution of the President of the Republic of Uzbekistan PQ-2646 dated October 28, 2016 'On Improving the System of Registration and Accounting of Business Entities'", the Board of the Central Bank of the Republic of Uzbekistan resolves:

1. Make amendments and additions to the Appendix to the Instruction on Opening Bank Accounts in Banks of the Republic of Uzbekistan, approved by the Resolution of the Board of the Central Bank of the Republic of Uzbekistan No. 7/2 dated March 16, 2009 (registration number 1948, April 27, 2009) (Collection of Legislation of the Republic of Uzbekistan, 2009, No. 18, Article 229), in accordance with the Appendix.

2. This resolution enters into force from April 1, 2017.

to the Resolution of the Board of the Central Bank of the Republic of Uzbekistan No. 4/5 dated March 4, 2017

Amendments and Additions Being Made to the Instruction on Opening Bank Accounts in Banks of the Republic of Uzbekistan

From the Preamble, remove the words: "of the Resolution of the Cabinet of Ministers of the Republic of Uzbekistan No. 357 dated August 20, 2003 'On Fundamental Improvement of the System of Procedures for Registration for Organizing Business Activity'".

From the sixth bullet point of paragraph 1, remove the word "in it".

The second bullet point of paragraph 3 shall be removed.

Paragraph 10 shall be stated as follows:

"10. Copies of the bank account contract serving as the basis for opening an account for subjects of entrepreneurial activity, including enterprises with foreign investment and enterprises with foreign capital, amendments made thereto, samples of cancelled signatures and sheets with seal impressions, as well as copies of documents certifying the identity of a person authorized to sign payment documents on behalf of the customer (passport or a document replacing it) are stored in the customer's legal file. Banks obtain information necessary for opening accounts for subjects of entrepreneurial activity and identifying them in the manner established by legislation from the 'Automated System for State Registration and Accounting of Business Entities'.

Copies of documents serving as the basis for opening accounts for resident legal entities that are not subjects of entrepreneurial activity, budget-funded organizations, representative offices and branches of resident legal entities, non-resident legal entities that are not subjects of entrepreneurial activity (foreign diplomatic and other official representative offices enjoying immunity and diplomatic privileges, international organizations and their branches, as well as representative offices of foreign organizations not engaged in economic or other commercial activity in the Republic of Uzbekistan), the bank account contract and amendments made thereto, founding documents (founding agreement, charter) and copies of amendments and additions made thereto, copies of notices sent to the bank that opened the main account regarding the opening of secondary accounts, samples of cancelled signatures and sheets with seal impressions, as well as copies of documents certifying the identity of a person authorized to sign payment documents on behalf of the customer (passport or a document replacing it) are stored in the customer's legal file.";

Paragraph 12 shall be stated as follows:

"12. The following documents are submitted to the bank for opening deposit accounts required in national currency by resident legal entities that are subjects of entrepreneurial activity, individual entrepreneurs, and peasant farms:

a) an application for opening an account in the form provided for in Appendix No. 2 to this Instruction;

b) two sheets with samples of signatures and seal impressions in the form provided for in Appendix No. 3 to this Instruction;

c) a document certifying the identity of a person authorized to sign payment documents on behalf of the customer (passport or a document replacing it). After the original identity document is shown, the bank makes a copy of it.".

The first bullet point of paragraph 36 shall be supplemented after the word "Archive" with the words: ", 'For Information', 'For Certificates'".

The second bullet point of paragraph 39 shall be stated as follows:

"If the information specified in the founding documents (founding agreement, charter) of resident legal entities that are not subjects of entrepreneurial activity, budget-funded organizations, representative offices and branches of resident legal entities, non-resident legal entities that are not subjects of entrepreneurial activity (foreign diplomatic and other official representative offices enjoying immunity and diplomatic privileges, international organizations and their branches, as well as representative offices of foreign organizations not engaged in economic or other commercial activity in the Republic of Uzbekistan) (founders, members, or other information) changes, they submit a copy of the amendments and additions made to the founding documents to the bank.".

Appendix No. 2
shall be supplemented after the abbreviation "M.O." with the words: "(if a seal is present)".
