RESOLUTION

On Amendments and Additions to the Resolution of the Board of the National Bank of the Kyrgyz Republic "On Approval of the Instruction on Work with Bank Accounts, Deposit Accounts (Deposits)" dated October 31, 2012 No. 41/12

In accordance with Articles 7 and 43 of the Law "On the National Bank of the Kyrgyz Republic", the Board of the National Bank of the Kyrgyz Republic resolves:

RESOLVES:

1. Make amendments and additions to the Resolution of the Board of the National Bank of the Kyrgyz Republic "On Approval of the Instruction on Work with Bank Accounts, Deposit Accounts (Deposits)" dated October 31, 2012 No. 41/12 (attached).

2. To the Legal Department:

• publish this resolution on the official website of the National Bank of the Kyrgyz Republic;

• after official publication, send this resolution to the Ministry of Justice of the Kyrgyz Republic for inclusion in the State Register of Regulatory Legal Acts of the Kyrgyz Republic.

3. This resolution enters into force after the expiration of fifteen days from the date of official publication.

4. The Department of Supervision and Licensing Methodology shall bring this resolution to the attention of commercial banks, the State Development Bank of the Kyrgyz Republic, regional departments, and the representation of the National Bank of the Kyrgyz Republic in the Batken region.

5. Control over the implementation of this resolution is assigned to the Deputy Chairman of the National Bank of the Kyrgyz Republic L.D. Orozbayeva.

	Appendix

Amendments and Additions to the Resolution of the Board of the National Bank of the Kyrgyz Republic "On Approval of the Instruction on Work with Bank Accounts, Deposit Accounts (Deposits)" dated October 31, 2012 No. 41/12

Make the following amendments and additions to the Resolution of the Board of the National Bank of the Kyrgyz Republic "On Approval of the Instruction on Work with Bank Accounts, Deposit Accounts (Deposits)" dated October 31, 2012 No. 41/12:

In the Instruction on work with bank accounts, deposit accounts (deposits), approved by the aforementioned resolution:

• in the first paragraph of paragraph 15, after the words "under a bank account agreement", add the words ", as well as individuals (residents) - agricultural producers in accordance with the requirements of this Instruction";

• supplement paragraph 15 with a fourth paragraph of the following content:

"The bank has the right to open a current (checking) account for individuals (residents) - agricultural producers who are landowners, land users, or engaged in livestock breeding, when issuing loans for the purpose of conducting and developing agriculture in the field of crop production and livestock breeding. The provision by these individuals of a document confirming state registration/re-registration (certificate) as an individual entrepreneur, and a copy of a document confirming engagement in entrepreneurial activity without state registration (patent) is not required. At the same time, individuals are obliged to present to the bank documents confirming land use rights, in accordance with the requirements of the legislation of the Kyrgyz Republic, or a document on the presence of livestock. The main part of payments under the loan must be carried out by non-cash means.";

• in sub-item 3 of paragraph 40, exclude the words "(minimum requirements imposed on this document are provided in Appendix 2)";

• in paragraph 41:

in sub-item 1, after the words "fact of passing state registration/re-registration", add the word "(certificate)";

in sub-item 1, after the words "without state registration", add the word "(patent)";

in sub-item 3, exclude the words "(minimum requirements imposed on this document are provided in Appendix 2)";

• in paragraph 43:

in sub-item 2, replace the word "Treasury" with the word "treasury";

in sub-item 2, after the words "for opening an account in a bank", add the words "for state bodies, enterprises and institutions financed from the state budget";

supplement sub-item 5 with a sentence of the following content:

"In the event that the legislation of the Kyrgyz Republic provides for the provision of a license after opening an account, a copy of the license is provided after its receipt;";

in sub-item 6, replace the word "certificate" with the word "certificate".
