Amends and consolidates the procedures for the registration of financial instruments representing credit operations and financial leasing, including those subject to credit assignment, fiduciary alienation, and portability, and in the form of credit rights, in asset registration and financial settlement systems authorized by the Central Bank of Brazil.
The Chief of the Department of Financial System Monitoring (Desig), acting in substitution, in the exercise of the authority conferred by Article 23, item I, letter “a”, of the Internal Regulations of the Central Bank of Brazil (BCB), annexed to Ordinance No. 84,287, of February 27, 2015, having in view the provisions of Article 77, item IV, of the aforementioned Regulations, based on CMN Resolutions Nos. 2,843, of June 28, 2001, 3,998, of July 28, 2011, 4,222, of May 23, 2013, 4,292, of December 20, 2013, 4,571, of May 26, 2017, and 4,593, of August 28, 2017, Circular No. 3,953, of July 10, 2019, and Circular Letter No. 3,968, of August 7, 2019, and in consequence of the provisions of Article 2 of Circular No. 3,553, of August 3, 2011,
RESOLVES:
Art. 1 Financial institutions and other institutions authorized to operate by the Central Bank of Brazil must report the Standardized Credit Operation Identifier (IPOC), as provided for in Circular No. 3,953, of July 10, 2019, in the registration of financial instruments representing credit operations and financial leasing, including those subject to credit assignment, fiduciary alienation, and portability, and in the form of credit rights, in asset registration and financial settlement systems authorized by the Central Bank of Brazil.
Sole Paragraph. For the generation of the identifier referred to in the main text, the guidelines contained in Circular Letter No. 3,968, of August 7, 2019, must be observed.
Art. 2 The identifier referred to in Article 1 must be reported for all credit operations linked to each of the instruments registered in asset registration and financial settlement systems authorized by the Central Bank of Brazil, in order to enable reconciliation with the information sent to the Credit Information System (SCR), in accordance with CMN Resolution No. 4,571 of May 26, 2017, it being observed that:
I - if the financial instrument is represented by a single IPOC in the SCR, this must be reported;
II - if the financial instrument is represented by more than one IPOC in the SCR, the institution must report one of the IPOCs.
§ 1 The institution must identify in the registration whether the reported IPOC refers to the situation described in item I or item II of the main text.
§ 2 The reporting of the IPOC is mandatory even if the data regarding the credit or credits referred to therein are not provided to the SCR individually.
Art. 3 For the purposes of this BCB Normative Instruction, credit operations are considered those listed in Article 3 of CMN Resolution No. 4,571, of 2017.
Art. 4 BCB Normative Instruction No. 30, of October 22, 2020, is revoked.
Art. 5 This BCB Normative Instruction enters into force on January 1, 2021.
