BANCO CENTRAL DE LA REPÚBLICA ARGENTINA
COMMUNICATION "A" 418 05/12/83
TO FINANCIAL ENTITIES, HOUSES, AGENCIES AND OFFICES AUTHORIZED TO OPERATE IN EXCHANGES AND FOREIGN EXCHANGE BROKERS:
Ref.: Circular FOREIGN EXCHANGE OPERATIONS REPORTING REGIME AND OBLIGATIONS WITH THE EXTERIOR - REFEX 1 - 11 - Surveys of the External Debt of the Private Sector as of 12.31.82 and 10.31.83
We address you to inform you that natural and legal persons of the private sector must report their obligations in foreign currency with the exterior as of 12.31.82 and 10.31.83 in accordance with the norms established by this communication. The survey as of 10.31.83 will serve as the starting point for the new reporting regime of obligations with the exterior. Simultaneously, at the request of the Federal Judiciary and to provide necessary information for a judicial investigation into the external debt, a survey of debt statements as of 12.31.82 will be carried out.
The submission of duly certified sworn external debt statements is an indispensable requirement for debtors to be authorized in the future to cancel the obligations covered by this norm. Presentations not made within the established deadlines will be considered "late" for the application of the provisions in force at the time of debt cancellation.
The present provision covers foreign currency obligations whose original amount exceeds USD 15,000 or its equivalent in other currencies, pending payment as of 12.31.82 or 10.31.82 or both dates, contracted directly with creditors resident in the exterior, or indirectly through financial entities resident in the country charged to their credit lines. All deferred payment obligations must be declared, even those that initially did not have such character, such as external obligations payable on demand, the payment of which was deferred by agreement between both parties. Additionally, external obligations payable on demand not cancelled as of 12.31.82 or 10.31.83 due to being pending approval, on those dates, of a payment request submitted to the Central Bank on form 4008 or 3687, must also be declared. Deferred payment obligations payable in foreign currency contracted with residents in the exterior and corresponding to services rendered and rents obtained in the country are also covered, even if the original currency of the obligation was Argentine pesos.
-2-
Obligations that have total or partial coverage of exchange insurance granted by the Central Bank on principal, interest, or both concepts, whose installments were due on the survey dates, must be declared, provided that their holders have not received from the creditors, on those dates, payment letters or similar documentation certifying the cancellation of the external debt obligation, regardless of whether countervalues in Argentine pesos have been deposited in the authorized financial entities where the operation was registered and the accounting treatment given to it.
Authorized financial entities for operating in exchanges must declare their own obligations and the credit lines received from their correspondents in the exterior, reporting the amounts used thereof, the conditions agreed with their correspondents, and the global application of said lines. Therefore, credit lines will be declared by financial entities globally, and by debtors who have received credits charged to these lines individually for each obligation covered by this norm.
The following are excluded from the surveys:
a) Obligations contracted by exporters for advance payments upon shipment or for export pre-financing and their interests, whether attributed or not to credit lines of authorized financial entities, insofar as such obligations have not been transformed into financial loans as of 12.31.82 or 10.31.83, according to what is established by Communication "A" 12 (COPEX - 1). b) Foreign currency deposits in authorized financial entities and loans received charged to the same.
II. Declaration of obligations.
Debtors must present form 5001 (Annex I) for each of the obligations pending cancellation as of 12.31.82, integrated according to the instructions given in Annex II of this communication. Likewise, each debtor must present form 5002 (Annex III) summarizing the declarations made on form 5001. Integrated according to the instructions of Annex IV.
Debtors with obligations as of 10.31.83 must present form 5003 (Annex V) and, if necessary, complementary forms 5003 A and 5003 B (Annex V), for each of the obligations pending cancellation on that date, integrated according to the instructions of Annex VI. Likewise, they must present form 5004 (Annex VII) summarizing the declarations made on form 5003, integrated according to the instructions of Annex VIII.
-3-
B.C.R.A. COMMUNICATION "A" 418 05/12/83
Duplicates of forms 2360, 2361, 2362, 3189, and 3191 of the "Permanent Survey of External Debt" (Communication "A" 21, REFEX - 1), corresponding to the external obligations now declared as part of the debt statement as of 10.31.83, must be returned to the Central Bank, added to the new declaration on form 5003.
Duplicates of forms 5003, 5003 A, and 5003 B will replace in all their effects forms 2360, 2361, 2362, 3189, and 3191. The Central Bank will timely communicate the norms applicable for updating obligations as of 10.31.83 and for declaring those contracted from 1.11.83.
The forms included in this provision must be machine-integrated. They will be presented in triplicate, with the exception of form 5006 (Annex IX), for which only the original presentation is required. All copies must be clearly legible. The original signature of the declarant must appear on the three copies. The certifications and Public Accountant intervention referred to in point III of this communication must appear, at minimum, on the original copy of forms 5001, 5002, and 5004 and on the original and one copy of forms 5003, 5003a, and 5003B. The duplicate will be returned to the declarant as proof of compliance with this norm, with the original and triplicate remaining in the possession of the Central Bank.
The receipt of external debt declarations does not imply approval of the data reported by the declarant.
In case of loss of the aforementioned duplicate, the declarant must manage a photocopy authenticated by the Central Bank, which will replace it in all its effects, with the applicant obliged to return said photocopy in the event the lost duplicate is located.
The Central Bank will not receive forms with integration errors or omissions, even if they meet the certification requirements stated in point III.
II. Certifications
Submissions to the surveys must meet the certification requirements indicated below:
c) Forms 5001, 5002, 5003, 5003 A, 5003 B, and 5004 must be certified regarding the signature of the debtor or their legal representatives by an authorized financial entity or by a public notary. d) Forms 5001 and 5003, corresponding to obligations contracted charged to credit lines of local financial entities, must be certified by the same. e) Forms 5001 and 5003, corresponding to obligations with creditors resident in the exterior backed or guaranteed by local financial entities, must be certified by the same.
-4-
d) Debtors must present an original Public Accountant report regarding their debts on each survey date, via form 5006 (Annex IX) integrated according to the instructions of Annex X. The Public Accountant will also intervene in all sworn statements. The Professional Council of Economic Sciences in which the intervening professional is registered will certify the Public Accountant's signature in their reports as well as on forms 5002 and 5004. Debtors who exclusively declare debts with local banks by application of credit lines are exempt from presenting the Public Accountant report and their intervention in sworn statements. The Central Bank, however, may request the presentation of the Public Accountant report in these cases in the future, if deemed necessary.
IV. Delivery of forms, inquiries, and deadlines for submission of sworn statements.
From December 7, 1983, forms and instructions will be delivered, inquiries will be attended, and sworn statements will be received at the premises on Bartolomé Mitre Street 300, Federal Capital, from 9 a.m. to 6 p.m.
Debtors will simultaneously present the sworn statements corresponding to the two surveys, according to the following schedule:
a) Until 12.30.83: debtors declaring up to 10 debts, including those of the two surveys. b) Until 1.6.84: debtors declaring up to 50 debts, including those of the two surveys. c) Until 1.13.84: debtors declaring up to 200 debts, including those of the two surveys. d) Until 1.20.84: debtors declaring more than 200 debts, including those of the two surveys.
Debtors who have not registered in the Debtors Registry, created by Communication "A" 407 of 11.10.83, must do so up to three business days before the deadline corresponding to them for the presentation of debt sworn statements.
Debtors who must request certifications from financial entities mentioned in points III.b) and III.c) must exhibit to the certifying entities the duplicate of their sworn statements intervened by the Central Bank, so that the entities can comply with the obligation determined in the last paragraph of point V.
V. Intervention of entities authorized to operate in exchanges
Authorized entities for operating in exchanges in the private sector must declare their own obligations with the exterior, including credit lines received from their correspondents in the exterior.
-5-
B.C.R.A. COMMUNICATION "A" 418 05/12/83
Public and private financial entities must certify the submissions of private debtors referring to obligations charged to their credit lines and to obligations backed or guaranteed by the same entities, according to what is indicated in point III.
To this end, they must inform their debtors as of 12.31.82 and 10.31.83 of the loans in force on those dates that were charged to their credit lines and those that were backed or guaranteed, so that debtors can proceed to present their individual debt sworn statements.
Public and private financial entities must take necessary precautions so that their private sector clients for obligations charged to their credit lines present the declarations provided for in this communication without errors, for which they will consult the Central Bank on situations giving rise to doubts. Ten business days after the last date of submission of debt declaration forms, public and private financial entities must communicate to the Central Bank, according to instructions to be made known timely, the list of private sector debtors charged to their credit lines and obligations backed or guaranteed by them, that have not presented at the Central Bank duly certified the corresponding debt sworn declaration forms.
VI. Debtors resident in the interior
Debtors residing in the interior may request forms, make inquiries, and present sworn statements for registration in the Debtors Registry and external debt by mail. To this effect, they will address themselves to the Central Bank of the Argentine Republic, External Debt Department, Reconquista 266, (1003) Buenos Aires.
We salute you very attentively.

INSTRUCTIONS FOR THE INTEGRATION OF
FORM NO. 5001: SURVEY OF EXTERNAL DEBT
AS OF 12.31.82 REQUIRED BY THE FEDERAL JUDICIARY - SWORN STATEMENT OF DEBT
Annex II to
Comm. “A”
418
Debtors covered by the provisions of point I. of this Communication must present one copy of form 5001 for each of the obligations pending cancellation as of 12.31.82, according to the scope of the definitions included in these instructions.
Regarding commercial debt, the integration of a form 5001 for each shipment will correspond, with the exception of the following cases where they must report jointly in a single form 5001:
a) Shipments made on the same date with allocation to the same letter of credit; b) Partial shipments to be allocated to the same letter of credit or to the same guarantee (e.g., "turnkey" contract), regardless of the dates on which they occurred, provided they correspond to a consolidated payment plan and equal interest rate and payment currency conditions.
Regarding financial debt, the integration of a form 5001 for each disbursement will correspond, with the exception of multiple disbursement cases, where the loan contract determines a common interest rate for all disbursements, the same payment currency, and a consolidated payment plan, regardless of the date on which the disbursements occurred. In this case, the disbursements must be reported jointly in a single form 5001.
If the debt falls within the concept "Other debts" (see item 15.), a declaration will be integrated for each obligation.
This form 5001 must be machine-integrated and presented in triplicate. The three copies must be clearly legible. The original signature of the declarant must appear on the form and on the copies. The certifications and Public Accountant intervention must appear on the original form, at minimum.
All declared amounts must be written without cents. Numerical information must be integrated aligned to the right margin of the corresponding boxes without using dots or commas. Dates will be indicated with numbers, using two digits for the day, two for the month, and two for the last two digits of each year.

4. Report the surname and first names or corporate name of the debtor, consistent with the information reported in Form 50001 ("Register of Debtors").
5. Report the debtor's registration number assigned by the B.C.R.A. through the submission of Form 5000 "Register of Debtors".
6. Declare in full the surname and first names or corporate name of the foreign creditor. If the space is insufficient, report according to the indications in item 50. (Observations). Debtors for imports financed by the exporter or a foreign financial entity shall report the name of the creditor that financed the operation. When the import is financed by a local bank against a credit line from abroad, the name of the exporter, followed by the legend "Credit Line", must be reported in this space.
In debts financed with banks or firms from abroad, the name of these entities shall be indicated as the creditor. If the financial debt was contracted with an authorized local financial entity through the application of a foreign credit line, the legend "Credit Line" shall be written in this space. When a financial entity declares its own debt due to the use of a credit line with a foreign correspondent bank, it shall report the name of the correspondent bank. In the case of syndicated loans, the name of the foreign bank leading the operation shall be reported. According to the instructions of item 50, the list of banks participating in the syndicated loan and their participation percentage shall be reported on an additional sheet.
7. Reserved for the B.C.R.A.
8. Report the full address of the natural or legal person indicated in item 6. When an exporter from abroad, a foreign bank, or any other non-resident natural or legal person has been declared as the creditor in this item, the respective address abroad shall be reported. When only "Credit Line" has been reported in item 6, the space shall be crossed out with a line.
9. Report the country code of the address of the natural or legal person declared in item 8. According to the corresponding table added as Annex XI of this Communication. When the creditor is an international organization (e.g., IBRD, IDB, CF), the code "200" shall be assigned, according to what is established in the respective table of Annex XI. When the space in item 8 has been crossed out, "999" shall be written.

11. Mark with "X" whether there is or is not an economic link between the debtor and the creditor in the terms of the Foreign Investment Law (text ordered in 1980).
12. Report the name of the local financial entity that intervened in the instrumenting of the commercial operation declared or in the currency negotiation of a loan. In the case of operations financed by a local bank through the use of a foreign credit line, the financial entity reported in this item is also the creditor. It shall be crossed out with a line in the case that there was no intervention of a local entity or that the declarant was an authorized entity.
13. Reserved for the B.C.R.A
14. Report the currency in which the obligation was contracted and its code, according to the corresponding table added as Annex XI of this Communication.
15. Report the currency in which payment of the obligation was agreed and its code, according to the corresponding table added as Annex XI of this Communication.
16. Mark with "X" the concept of the obligation, according to the indicated classification. Only one concept must be marked. This classification applies both to deferred payment obligations and to delays in cash payments, that is, obligations agreed for cash payment whose cancellation, requested in Form 4008 or 3687, was pending approval at the B.C.R.A. as of 12.31.82.
All obligations originating directly from imports shall be considered "Commercial Debt" even if a local financial entity has intermediated in the operation using a credit line. Likewise, it shall be considered "Commercial Debt" that which responds to a contract by which a debt for imports is renewed, through direct agreement with suppliers. The current, overdue and unpaid interest as of 12.31.82 originating from "Commercial Debt", as long as the principal payment obligation subsists, shall be declared in item 45. Of the same Form 5001 that contains the declaration of the principal. The declaration of commercial debts must be made by the importer completing items 17. To 20. Inclusive, crossing out with a line the spaces corresponding to items 21. To 35.
-4-
"Financial Debt (Credit Line)" shall be considered the obligations contracted by entities authorized to operate in exchange with their correspondents abroad, according to their own modality (e.g., special accounts, advances, acceptances, "call", etc.). In the case of these obligations, financial entities must complete item 21. Crossing out with a line the spaces corresponding to items 17. to 20. And 22. to 35. Financial entities shall report the conditions agreed with their foreign creditor and not the conditions governing the applications of those credit lines with their clients. "Financial Debt (Loans and Swap Operations)" shall be considered all credit received in foreign exchange, whether settled by the declarant in the local exchange market (entered loans) or applied by the declarant for the operations mentioned in items 28. To 33. (non-entered loans). This concept includes debts contracted with local financial entities through the use of their credit lines. Loans from international organizations in all cases must be declared as "Financial Debt". Swap operations, including those of financial entities, constitute a particular case of financial debt, even if they have been used to cancel imports (regime of Communication "A" 162). The current, overdue and unpaid interest as of 12.31.82, originating from "Financial Debt (Credit Lines, Loans and Swap Operations)", as long as the principal payment obligation subsists, shall be declared in the same Form 5001 that contains the declaration of the principal. Declarants of this type of obligation must complete items 22. To 33. Crossing out with a line the spaces corresponding to items 17. to 21., 34 and 35. "Other Debts" shall be declared as obligations originating in the deferred payment abroad of services or rents, delays in cash payments of such concepts with Form 4008 or 3687 pending authorization at the B.C.R.A. as of 12.31.82, punitive interest and interest for delay. Current interest owed for commercial or financial obligations shall be included in this category only in the case that the principal payment obligation does not subsist. Freight when it does not correspond to its declaration by the importer according to what is established in item 20.), profits and dividends, royalties, and in general, all concepts included in the respective table of Annex XI, whose payments have been deferred, are part of this group of obligations. In the space next "Specify" the relevant concept shall be indicated and the code shall be assigned according to the table of concepts added as Annex XI to this Communication. If the concept "Other obligations without discrimination" of the concepts table of that annex is reported, its nature shall be explained according to the instructions given in item 50. (Observations). When these obligations are declared, items 34. And 34. must be completed, crossing out with a line the spaces corresponding to items 17. To 33. Delays in cash payments agreed can only be classified as
"Commercial Debt" or "Other Debts". In these cases, a Form 5001 must be presented for each Form 4008 or 3687 pending authorization by the B.C.R.A. as of 12.31.82. and completed in each form items 17. To 20, or 34. And 34., as appropriate. If the delay in cash payment corresponds to be classified as "Other Debts", the origin date of the obligation is that on which the payment became due and the original amount of the debt is the one requested to transfer.

17. Report the shipment date according to the corresponding documentation. If as of 12.31.82 there were partial shipments with allocation to the same letter of credit that corresponds to report jointly, the date of the first shipment shall be mentioned as the shipment date.
18. Mark with "X" the class of instrumenting used in the import according to the indicated groups. "Letters" shall be indicated when this document is used and there is no Letter of Credit or Collection.
19. Mark with "X" whether it is an import of current or capital goods. "Capital" goods shall be considered those included in the list of Annex I of Circular COPEX - 1, Communication "A" 12; the remaining goods shall be considered "current". In the case that the operation comprises goods of both types, the one with the highest participation in the value of the obligation declared shall be reported.
20. Report the discrimination of the original amount of the debt expressed in the currency of origin, without cents, even if the debt is partially cancelled as of 12.31.82. It is emphasized that the original amount of the debt shall be understood as only the deferred part of the value of the import. If as of 12.31.82 there were partial shipments, which corresponded to report jointly according to the conditions of the documentary credit, the original amount of the debt shall be declared as the accumulated value of the deferred payment amounts of said shipments. The concepts "freight", "insurance", etc., shall only be reported in the case that they are part of the total amount of the debt originally contracted with the creditor and shall be included in "Others". The interest of these obligations shall not be reported in this item; for their declaration, the procedure shall be according to what is indicated in items 44.
And 45.
21. Entities authorized to operate in exchange must report the destination given to all credit lines obtained from their correspondents abroad as of 12.31.82 globally, including applications for amounts less than Dls. 15,000, using one Form 5001 for each credit line. Credit lines in foreign exchange of convention must also be included. In "Export Financing" (item 21a.) loans or advances granted to local exporters on account of future export collections shall be included. In "Import Financing" (item 21b.) applications to letters of credit or other financing instruments to importers for shipments already made shall be registered. In "Financial loans with forward coverage (item 21c.) and "Other financial loans" (item 21d.) the amounts of the credit line applied to local loans shall be indicated, whether there is forward coverage through insurance or swap operations in favor of local borrowers. In "Other applications" (item 21e.) other destinations not specified previously shall be reported. In "Unapplied amount" (item 21f.) the amount of the credit line not lent to residents in the country as of 12.31.82 shall be reported. All amounts must be expressed in the currency of origin of the debt with the foreign creditor (item 14.), without cents. The date of granting the credit line shall be reported in 21g.

NO. 5003, 5003 A and 5003 B: SURVEY OF EXTERNAL DEBT AS OF 31.10.83 SWORN DEBT DECLARATION
Annex VI
to Comm.
“A” 418
Debtors covered by the provisions of point I. of this Communication must submit one copy of form 5003 for each of the obligations pending cancellation as of 31.10.83, in accordance with the scope of the definitions included in these instructions. Regarding commercial debt, one form 5003 must be completed for each shipment, except for the following cases where they must be reported jointly in a single form 5003:
a) Shipments made on the same date with allocation to the same letter of credit; b) Partial shipments to be allocated to the same letter of credit or to the same guarantee (e.g., "turnkey" contract), regardless of the dates on which they occurred, as long as they have a consolidated payment plan and equal interest rate and payment currency conditions. Regarding financial debt, one form 5003 must be completed for each disbursement, except in the case of multiple disbursements, where the loan contract determines a common interest rate for all disbursements, the same payment currency and a consolidated payment plan, regardless of the date on which the disbursements occurred. In this case, the disbursements must be reported jointly in a single form 5003. If the debt falls under the concept "Other Debts" (see item 16.), a declaration must be integrated for each obligation. Forms 5003 A and 5003 B are intended to complement the information provided in form 5003, when the space assigned to the payment plan (principal or interest) is insufficient to cover all installments that must be declared. These forms (5003, 5003 A and 5003 B) must be typed and presented in triplicate. The three copies must be clearly legible. The original signature of the declarant must appear on each form and on the copies. Certifications and Public Accountant intervention must be recorded on the original copy and on one copy, at minimum. All declared amounts must be written without cents. Numerical information must be aligned to the right margin of the corresponding boxes without using periods or commas. Dates must be indicated with numbers, using two digits for the day, two for the month and two for the last two digits of each year.
-2-
(The instructions contained in items 1. to 5. and 14. are applicable to forms 5003, 5003 A and 5003 B. The instructions contained in items 6. to 13. and 15. to 35. are applicable only to form 5003).

INSTRUCTIONS FOR THE COMPLETION OF FORMS
No. 5003, 5003 A and 5003 B: SURVEY OF EXTERNAL DEBT AS OF 10.31.83 SWORN DEBT DECLARATION
Annex VI
to Com.
“A” 418
Report the country code of the domicile of the natural or legal person declared in item 8. According to the corresponding table added as Annex XI of this Communication. When the creditor is an international organization (e.g., IBRD, IDB, IFC), the code “200” shall be assigned according to what is established in the respective table of Annex XI. When the space in item 8 has been crossed out, write “999”.
Assign number according to the following table:
1 - International organizations (e.g., IBRD, IDB, IFC).
2 - Governmental financial institutions of other countries (e.g., EXIMBANK).
3 - Foreign commercial banks.
4 - Syndicated credits.
5 - Holders of securities and bonds issued by the private sector in foreign currency.
6 - Foreign suppliers.
7 - Other foreign private creditors.
8 - Other foreign public creditors.
9 - Foreign credit lines from local banks.
The number shall be assigned according to what is declared in item 6. Number 9 shall be assigned when the legend “Credit Line” or the exporter’s name followed by the legend “Credit Line” has been written.
Mark with “X” whether there is or is not an economic link between the debtor and the creditor in the terms of the Foreign Investment Law (text ordered in 1980).
Report the name of the local financial entity that intervened in the instrumenting of the commercial operation declared or in the foreign exchange negotiation of a loan. In the case of operations financed by a local bank through a foreign credit line, the financial entity reported in this item is also the creditor. It shall be crossed out with a line in the case that there was no intervention of a local entity or that the declarant was an authorized financial entity.
Reserved for the B.C.R.A.
Report the currency in which the obligation was contracted and its code according to the corresponding table added as Annex XI of this Communication.
Report the currency in which payment of the obligation was agreed and its code according to the corresponding table added as Annex XI of this Communication.
-4-
All obligations originating directly from imports shall be considered “Commercial Debt” even if a local financial entity has intermediated in the operation using a credit line. Likewise, it shall be considered “Commercial Debt” that which responds to a contract by which a debt for imports is renewed, through direct agreement with suppliers. Current, overdue, and unpaid interest as of 10.31.83, originating from “Commercial Debt”, as long as the payment obligation of the principal subsists, as well as unpaid interest, shall be reported jointly with the principal obligation in the part corresponding to interest in the payment plan. The declaration of commercial debts must be made by the importer completing items 17. to 20. Inclusive, crossing out with a line the spaces corresponding to items 21. to 35.
“Financial Debt (Credit Line)” shall be considered the obligations contracted by entities authorized to operate in foreign exchange with their correspondents abroad, according to their own modality (e.g., special accounts, advances, acceptances, “call”, etc.). In the case of these obligations, financial entities shall complete item 21. crossing out with a line the spaces corresponding to items 17. to 20. and 22. to 34. Financial entities shall report the conditions agreed with their foreign creditor and not the conditions governing the applications of those credit lines with their clients.
“Financial Debt (Loans and Swap Operations)” shall be considered all credit received in foreign currency, whether settled by the declarant in the local foreign exchange market (entered loans) or applied by the declarant for the operations mentioned in items 28. to 33. (non-entered loans). This concept includes debts contracted with local financial entities through the use of their credit lines. Loans from international organizations in all cases must be declared as “Financial Debt”. Swap operations, including those of financial entities, constitute a particular case of financial debt, even if they have been used to cancel imports (Regime of Communication “A” 162). Current, overdue, and unpaid interest as of 10.21.83 originating from “Financial Debt (Credit Lines, Loans and Swap Operations)”, as long as the payment obligation of the principal subsists, as well as unpaid interest, shall be reported jointly with the principal obligation in the part corresponding to interest in the payment plan. Declarants of this type of obligations must complete items 22. to 33., crossing out with a line each of the spaces corresponding to items 17. to 21., 34. and 35.
“Other Debts” shall be declared as obligations originating in the deferred payment abroad of services or rents, delays in cash payments of such concepts with forms 4008 or 3687 pending authorization by the B.C.R.A. as of 10.31.83. Punitive interest and interest for delay. Current interest owed for commercial or financial obligations will be included in this category only in the case that the payment obligation of the principal does not subsist. Freight (when its declaration does not correspond for the importer according to what is established in item 2.), profits and dividends, royalties, and, in general, all concepts included in the respective table of Annex XI, whose payments have been deferred, form part of this group of obligations. In the space next “Specify” the relevant concept will be indicated and the code will be assigned according to the table of concepts added as Annex XI to this Communication. If the concept “Other Obligations without discrimination” from the concepts table of that annex is reported, its nature will be explained according to the instructions given in item 50. (Observations). When these obligations are declared, items 34. and 34. must be completed, crossing out with a line the spaces corresponding to items 17. to 33.
Delays in agreed cash payments can only be classified as “Commercial Debt” or “Other Debts”. In these cases, a form 5003 must be presented for each form 4008 or 3687 pending authorization by the B.C.R.A. as of 10.31.83 and items 17. to 20. or 34. and 34. must be completed in each form, as appropriate. If the delay in cash payment corresponds to be classified as “Other Debts”, the origin date of the obligation is that on which the payment became due and the original amount of the debt is the one requested to transfer.
Report the shipment date according to the corresponding documentation. If as of 10.31.83 there were partial shipments with allocation to the same letter of credit that must be reported jointly, the date of the first one realized must be mentioned as the shipment date.
Mark with “X” the class of instrumenting used in the import according to the indicated groups. “Letters” shall be indicated when this document is used and there is no Letter of Credit or Collection.
Mark with “X” whether it is an import of current or capital goods. “Capital” goods shall be considered those included in the list of Annex I of Circular COPEX - 1, Communication “A” 12; the remaining goods will be considered “current”. In the case that the operation comprises goods of both types, the one with the greater participation in the value of the obligation declared must be reported.
Report the discrimination of the original amount of the debt expressed in the currency of origin, without cents, even if the debt is partially cancelled as of 10.31.83. It is emphasized that the original amount of the debt must be understood as only the deferred part of the value of the import. If as of 10.31.83 there were partial shipments, which should be reported jointly according to the conditions of the documentary credit, the original amount of the debt shall be declared as the accumulated value of the deferred payment amounts of said shipments. The concepts “freight”, “insurance”, etc., will only be reported in the case that they form part of the total amount of the debt originally contracted with the creditor and must be included in “Others”. Interest on these obligations must not be reported in this item; for their declaration, one must proceed according to what is indicated in items 36b. to 42b.
-6-
Entities authorized to operate in foreign exchange must report the destination given to all credit lines obtained from their correspondents abroad as of 10.31.83 globally, including applications for amounts less than USD 15,000, using a form 5003 for each credit line. Credit lines in foreign currency under agreement must also be included. In “Export Financing” (item 21a.) loans or advances granted to local exporters on account of future export collections will be included. In “Import Financing” (item 21b.) applications to letters of credit or other financing instruments for importers for shipments already made will be registered. In “Financial Loans with term coverage” (item 21c.) and “Other Financial Loans” (item 21d.) the amounts of the credit line applied to local loans will be indicated, according to whether there is or is not term coverage through insurance or swap operations in favor of local borrowers. In “Other applications” (item 21e.) other destinations not specified previously will be reported. In “Unapplied Amount” (item 21f.) the amount of the credit line not lent to residents in the country as of 10.31.83 will be reported. All amounts must be expressed in the currency of origin of the debt with the foreign creditor (item 14.), without cents. The date of granting the credit line will be reported in 21g.
Report the date on which the first or only disbursement of the current contract was made, whether it gave rise to or not to an entry of foreign currency. In the case that the contract is expired and not renewed, or the terms have been extended, the date of the first or only disbursement of the original contract will be reported.
Report the amount of foreign currency negotiated in the foreign exchange market, corresponding to the contract declared, expressed in the currency of origin of the obligation (item 14.), without cents. It corresponds to declare in this item, for example, obligations with exchange insurance under the regime of Communication “A” 31 and complementary ones that have given rise to the entry of foreign currency. It also corresponds to declare in this item the operations made under the regime of Communication “A” 162.
Obligations with exchange insurance under the regime of Communication “A” 137 must not be declared in this item but in item 26. (Amount not entered) and, as appropriate, in items 28. to 33. The same criterion will apply to obligations with exchange insurance under the regime of Communication “A” 31 and complementary ones that have not given rise to the entry of foreign currency.
Report the date on which the foreign currency corresponding to the last or only disbursement was settled in the foreign exchange market.
Mark with “X” the class of form used to declare the sale of foreign currency, by the debtor, corresponding to the last or only disbursement and indicate its letter and number.
Report the unentered amount of the obligation, without cents, which must be equal to the sum of the concepts stated in items 28. to 33.
Report the original amount of the loan by adding the concepts “entered” and “not entered” (item 23. and 26.), regardless of whether at the date of the declaration the obligation was partially cancelled.

The installments will be reported in the order of their due date, from the first installment pending payment, overdue or to mature. The due date and the corresponding amount for operations agreed as cash payment overdue will be reported in the “Payment plan of pending debt - CAPITAL”. Also included in this section will be the amounts owed in concept of interest for delay, punitive interest and current interest when the obligation of the principal does not subsist.

In the column “Class of form”, the number and letter of the form used for cancellation (4002 A, 4004 b, 3688 or other) will be reported in the upper row and in the row used for cancellation (4002 A, 4004 B, 3688 or other) and in the lower row the number assigned by the intervening authorized institution. In the case of cancellation through a new loan or of cancellation without use of foreign currency, report in “Date” the date of the loan amortization and in the column “Class of form” write “New loan” or “Without foreign currency” as appropriate. The payment currency code will be taken from the corresponding table added as Annex XI of this Communication and it must coincide with that reported in item 15. If the currency of origin is not equal to the currency of payment, the swap rate applied must be reported according to the instructions given in item 50. (Observations).
