Rule · CVM · 26 Apr 2013
Portfolio administrators, including accredited natural persons, must submit the Annual Registration Report and Electronic Declaration of Compliance by May 31, 2013, via the CVM system’s “Document Submission via Form” under “Annual (Mandatory)”. These obligations apply even with no assets under management. Failure to submit by the deadline incurs a daily penalty fine under CVM Instruction No. 452/07, capped at 60 days.
CIRCULAR LETTER/CVM/SIN/No. 6/2013
Rio de Janeiro, April 26, 2013
To the Administrators of Securities Portfolios
Subject: Annual Registration Report of Portfolio Administrators and Electronic Declaration of Compliance
Dear Sirs,
As is known, the period for submitting the Annual Registration Report of Portfolio Administrators (“ICAC”) provided for in Article 12 of CVM Instruction No. 306/99 began on 4/1/2013 and extends until 5/31/2013. We also remind you that, pursuant to Article 1, II, of CVM Instruction No. 510/2011, it is the duty of portfolio administrators to provide, by 5/31/2013, the Electronic Declaration of Compliance, in which the participant confirms the consistency of their registration data.
In this context, considering that the ICAC maintained available in the CVMWeb system already contains all the information required by these two periodic obligations, we inform you that both requirements can be met by the portfolio administrator through the submission of only this report, via the “Document Submission” option available on the website www.cvm.gov.br.
After accessing the system with your password, the participant must look for the item “Document Submission via Form”, then the document “Registration Report”, report type “Annual (Mandatory)”, function “Submit Documents”. We inform you that the method of submitting this document is also explained in item 2.2 of Circular Letter CVM No. 4/2012.
It is important to note that these obligations must be fulfilled even if the administrator has no assets under their management, and that no changes to the registry of this Autarchy are necessary. The submission of the document is also mandatory by an accredited administrator, a natural person, who is responsible for the administration of securities portfolios in a legal entity authorized by the CVM to exercise such activity.
After the report has been entered, it is possible and recommended to perform a query to verify if the information was accepted by the system. To do so, similarly, the item “Document Submission via Form” must be accessed, option “Registration Report”, but now, the function “Search Document”. To query, for example, the report submitted by 5/31/2013, the year of search “2013” must also be entered.
Furthermore, we inform you that we have already requested the necessary adaptations to the ICAC form from the competent area of the CVM to make clearer the compliance, through the submission of that report, with both of the above-cited obligations.
Finally, we remind you that the failure to submit this report by the deadline subjects the participant to the application of a daily penalty fine provided for in the applicable regulation, up to a limit of 60 days, pursuant to Article 14 of CVM Instruction No. 452/07.
Sincerely,
FRANCISCO JOSÉ BASTOS SANTOS
Superintendent of Institutional Investor Relations
