Rule · BCB · 5 Nov 1998 · Resolução CMN 2561
Financial institutions and leasing companies may assign credits arising from loan, financing, and leasing operations, subject to prohibitions on assigning credits in liquidation accounts or via forward repurchase. Acquisitions of credits with foreign exchange variation clauses must use resources from foreign loans. Assignments to non-National Financial System persons require Central Bank authorization, must be without co-obligation, settled on a spot basis, and include specific balance sheet disclosures. This Resolution replaces Resolutions 1,962/92 and 2,412/97 and Circular Letter 2,605/95, entering into force upon publication.
Amends and consolidates norms on the assignment of credits.
