Rule · BCB · 13 May 2024 · Resolução CMN 5133
CMN Resolution No. 5133 exempts credit restructurings executed between May 1 and December 31, 2024, in the state of Rio Grande do Sul due to climate emergency impacts from being classified as problem assets under specific Central Bank regulations. This exemption allows for the immediate reversal of existing problem asset classifications for these operations, provided they were not already classified as such at the time of publication and do not show evidence of the counterparty's inability to meet new obligations. Financial institutions must retain credit analysis documentation for five years, while the resolution explicitly excludes consortium administrators, payment institutions, securities brokers, and currency brokers from its scope.
