The European Commission establishes fees charged by the European Securities and Markets Authority (ESMA) to central counterparties (CCPs) established in third countries. Third-country CCPs must pay a basic recognition fee of EUR 50,000 and an additional fee of EUR 360,000 if classified as Tier 2 systemically important entities. Annual fees are calculated based on ESMA's budget, with Tier 1 CCPs sharing a fixed amount and Tier 2 CCPs paying amounts weighted by their worldwide clearing revenues, categorized into two groups based on a EUR 600 million turnover threshold. The regulation specifies payment deadlines, prohibits reimbursement of fees, and requires an interim annual fee of EUR 50,000 for already recognized CCPs until their tier classification is determined.
