Final Report on Technical Advice to the European Commission on Fees Charged to Tier 1 Third-Country CCPs under EMIR
ESMA issues updated technical advice to the European Commission proposing revisions to the Fees Delegated Regulation to ensure annual fees for Tier 1 Third-Country CCPs are proportionate to their global turnover. The proposal replaces the current flat fee structure with a weighted system based on three revenue groups, utilizing audited clearing revenues to allocate supervisory costs more accurately. Additionally, ESMA introduces a minimum annual fee of EUR 50,000 for smaller CCPs to cover baseline monitoring activities and addresses consultation feedback regarding data submission timelines.
