Commission Delegated Regulation (EU) 2022/1455 on regulatory technical standards for own funds requirements for investment firms based on fixed overheads

The European Commission adopted Delegated Regulation (EU) 2022/1455 to supplement Regulation (EU) 2019/2033 by establishing regulatory technical standards for calculating the own funds requirement for investment firms based on fixed overheads. The regulation specifies that profit shares and certain bonuses must be calculated based on net profits, defines deductible expenses including trading fees and raw material costs for specific dealers, and sets objective thresholds for material changes in projected fixed overheads. Specifically, a material change is defined as a variation of 30% or more in projected fixed overheads or a change in own funds requirements equal to or greater than EUR 2,000,000. This regulation entered into force on the twentieth day following its publication in the Official Journal of the European Union.
