Commission Implementing Regulation (EU) 2026/1288 on the stand-alone suspension of the trading obligation for derivatives

The European Commission suspends the derivative trading obligation for BNP Paribas SA, Société Générale SA, Crédit Agricole CIB, and Deutsche Bank AG regarding transactions with counterparties in the United Kingdom. This exemption applies under Article 32a(1) of Regulation (EU) No 600/2014, allowing these financial counterparties to act as market makers in OTC derivatives and credit default swaps on non-equivalent UK venues. The suspension is subject to a five-year review cycle starting on 18 June 2026, during which competent authorities must provide updated evidence of compliance and notify the Commission of any breaches.
