CVM Instruction No. 360 amends Articles 2, 11, 22, and 23-A of CVM Instruction No. 279/1998 to regulate the constitution, administration, and operation of Mutual Funds for Privatization – FGTS. The amendments specify that fund shares must be capitalized using converted FGTS balances or transferred resources, restrict fund mergers and incorporations to those holding securities from the same issuer or with compatible investment policies, and mandate that initial acquisitions target securities from a single issuer. Additionally, the rule requires that resources from transfers occurring before the financial settlement of privatization programs be invested in private or federal public fixed-income titles, and imposes a 180-day deadline to reduce fixed-income holdings to below 10% of net asset value if they exceed that threshold, while requiring Free Portfolio Funds to comply with specific limits within 60 days of commencing activities.
