CVM INSTRUCTION NO. 458, OF AUGUST 16, 2007.

Amends CVM Instruction No. 356, of December 17, 2001.

The PRESIDENT OF THE SECURITIES AND EXCHANGE COMMISSION – CVM makes public that the Collegiate Board, in a meeting held on August 14, 2007, considering the provisions of Articles 2, item IX, and 8, item I, of Law No. 6,385, of December 7, 1976, HAS DECIDED to issue the following Instruction:

Art. 1 Article 38 of CVM Instruction No. 356, of December 17, 2001, shall be effective with the following wording:

“Art. 38......
......
§5 In funds where the custodian utilizes the option provided for in §3, the automatic registration referred to in §1 of Art. 8 shall not be granted, and the analysis periods provided for in Arts. 8 to 10 of CVM Instruction No. 400/03 must be observed” (NR)

Art. 2 Paragraph 4 of Art. 38 of CVM Instruction No. 356, of 2001, is hereby repealed.

Art. 3 This Instruction enters into force on the date of its publication in the Official Gazette of the Union.
