Rule · CVM · 26 Nov 2013
Investment fund managers must limit holdings in non-listed invested companies to 35% of net equity, rising to 100% during the six-month application period post-subscription. This cap excludes companies in special trading segments with stricter governance standards. If passive non-compliance persists through the end of the following month, administrators must immediately notify the CVM with justifications and a re-compliance forecast, then report once compliance is restored. These rules amend CVM Instruction No. 391 and take effect upon publication.
