THE PRESIDENT OF THE BRAZILIAN SECURITIES COMMISSION - CVM makes public that the Collegiate Body, in a meeting held on June 6, 2018, based on arts. 1, VI, 8, I, and 24 of Law No. 6,385, of December 7, 1976, on arts. 27, 34, § 2, 41, 101 and 293 of Law No. 6,404, of December 15, 1976, and on art. 24, § 2, of Law No. 12,810, of May 15, 2013 APPROVED the following Instruction:
Art. 1 The items XXIX, XXX, XXXI, XXXII and XXXIII of Annex 1 of CVM Instruction No.
510, of November 29, 2011, shall come into force with the following wording:
“XXIX – securities bookkeeper;
XXX – securities custodian;
XXXI – REVOKED;
XXXII – REVOKED;
XXXIII – REVOKED;” (NR)
Art. 2 The items XXIX, XXX, of Annex 2 of CVM Instruction No. 510, of November 29, 2011, shall come into force with the following wording:

“Art. 5 The request for authorization to act as a custodian must be submitted to the Superintendence of Market Relations and Intermediaries – SMI, by presenting an application accompanied by the documents described in Annex 5. Sole Paragraph. The SMI may request complementary elements and information from the applicant.” (NR) “Art. 6 Authorization shall be automatically granted if the request is not denied by the SMI within 90 (ninety) days from its submission, upon protocol. § 1 The period referred to in the caput may be interrupted only once, in the event that the SMI requests additional documents and information related to the authorization request from the applicant, with a new period of 90 (ninety) days beginning from the fulfillment of the requirements.” (NR)

I – is not accompanied by the necessary documents for its appraisal, or if the complementary documents and information requested by the SMI are not provided within the period fixed in § 2 of art. 6; ......” (NR)

II – by decision of the SMI, after an administrative process in which due process and full defense are ensured, in the following hypotheses:

§ 1 In the hypothesis provided for in item I of the caput, the custodian must present to the SMI evidence that it has returned to investors or transferred, by direct guidance or in the form of the respective contract, to another custodian all securities it held in custody. ......” (NR) Art. 4 The arts. 6, 7, 8, 9 and 10 of CVM Instruction No. 543, of December 20, 2013, shall come into force with the following wording:
“Art. 6 The request for authorization to provide securities bookkeeping services must be submitted to the Superintendence of Market Relations and Intermediaries – SMI, by presenting an application accompanied by the documents described in Annex 6 of this Instruction. Sole Paragraph. The SMI may request complementary elements and information from the applicant.” (NR)
