CVM Resolution 244 amends Resolution CVM No. 193 by establishing that entities opting to publish sustainability-related financial information must do so for at least three consecutive fiscal years and must notify the market if they decide to cease such voluntary disclosures. It requires open companies that choose not to file a sustainability report to justify this decision via market communication by the annual financial statement filing deadline, starting January 1, 2027. Additionally, it mandates explicit adherence to standards issued by the CBPS and ISSB and sets filing deadlines for sustainability reports, requiring submission by the FRE form deadline in the first year and within three months of fiscal year-end or simultaneous with financial statements in subsequent years. These rules apply to fiscal years beginning on or after January 1, 2026.
