Deposit Protection Scheme (Asset Maintenance) Rules

Scheme members must maintain assets in Hong Kong per Monetary Authority requirements, capped at 200% of relevant deposits. Assets must be unencumbered, recorded in Hong Kong accounts, and not claims on related companies; bearer securities require documents of title kept in Hong Kong, while registered securities must be transferable at a Hong Kong register. Intermediary-held securities require the intermediary to be located in Hong Kong with records kept there. Non-compliance by a Scheme member constitutes an offence for every director and chief executive, liable on summary conviction to a level 6 fine, six months’ imprisonment, and a continuing daily fine of $10,000, or on indictment to a $400,000 fine and two years’ imprisonment with a continuing daily fine of $20,000. The Rules came into operation on 15 January 2007.
