ESMA opinion under Article 43(2) MiFIR on Slovenian product intervention measures for CFDs

The European Securities and Markets Authority issued an opinion on the permanent restriction proposed by Slovenia's regulator on the marketing of contracts for difference to retail clients. ESMA concluded that these national measures are justified and proportionate because they replicate previous EU-wide restrictions that had expired. The authority further determined that it is necessary for other Member States to adopt equally stringent measures to prevent regulatory arbitrage and ensure consistent investor protection across the Union.
