CONCERNING
REPORTING BY RURAL BANKS AND SHARIA RURAL FINANCING BANKS THROUGH THE FINANCIAL SERVICES AUTHORITY REPORTING SYSTEM BY THE GRACE OF GOD THE ALMIGHTY THE COMMISSIONERS OF THE FINANCIAL SERVICES AUTHORITY,
Considering:
a. that for the supervision of the Financial Services Authority over rural banks and sharia rural financing banks, complete, accurate, current, comprehensive, and comparable data and information on rural banks and sharia rural financing banks are required; b. that to obtain data and information on rural banks and sharia rural financing banks effectively and efficiently, reports from rural banks and sharia rural financing banks are submitted to the Financial Services Authority through the Financial Services Authority Reporting System;
c. that based on the considerations referred to in letters a and b, it is necessary to establish a Financial Services Authority Regulation concerning Reporting by Rural Banks and Sharia Rural Financing Banks through the Financial Services Authority Reporting System;
Recalling:
DECIDING:
Establishing: FINANCIAL SERVICES AUTHORITY REGULATION CONCERNING REPORTING BY RURAL BANKS AND SHARIA RURAL FINANCING BANKS THROUGH THE FINANCIAL SERVICES AUTHORITY REPORTING SYSTEM.
CHAPTER I
GENERAL PROVISIONS
Article 1
In this Financial Services Authority Regulation, the following terms are defined:
CHAPTER II
BPR AND BPRS REPORTS THROUGH THE FINANCIAL SERVICES AUTHORITY REPORTING SYSTEM
Article 2
(1) BPR and BPRS reports through the Financial Services Authority Reporting System include:
a. BPR Monthly Report; b. BPRS Monthly Report;
c. business plans and reports on the realization of BPR and BPRS business plans based on Financial Services Authority Regulation provisions; and
d. other reports submitted by BPRs and BPRSs online based on Financial Services Authority Regulation provisions.
(2) BPRs and BPRSs are required to prepare and submit BPR and BPRS reports as referred to in paragraph (1) to the Financial Services Authority through the Financial Services Authority Reporting System in a complete, accurate, current, comprehensive, and timely manner. (3) BPRs and BPRSs are responsible for the truthfulness and completeness of the content and the timeliness of the submission of BPR and BPRS reports through the Financial Services Authority Reporting System as referred to in paragraph (2).
Article 3
(1) The obligation to submit BPR and BPRS reports through the Financial Services Authority Reporting System as referred to in Article 2 paragraph (2) may be exempted for:
a. BPRs and BPRSs that have been operating for a maximum of 3 (three) months since commencing operational activities; and/or b. BPRs and BPRSs experiencing technical difficulties.
(2) BPRs and BPRSs obtain the exemption as referred to in paragraph (1) by submitting a notification letter to the Financial Services Authority accompanied by reasons.
(3) BPRs and BPRSs as referred to in paragraph (1) letter a submit BPR and BPRS reports offline.
(4) The submission of BPR and BPRS reports as referred to in paragraph (3) must be done no later than the next working day if the reporting period deadline falls on a Saturday, Sunday, or public holiday. (5) BPRs and BPRSs as referred to in paragraph (1) letter b submit BPR and BPRS reports offline. (6) The submission of reports as referred to in paragraph (5) must be done no later than 3 (three) working days after the submission deadline for BPR and BPRS reports, accompanied by a notification letter to the Financial Services Authority and supporting documents. (7) If technical difficulties can be resolved before 3 (three) working days as referred to in paragraph (6) and BPRs and BPRSs do not submit reports offline, BPRs and BPRSs as referred to in paragraph (1) letter b are required to submit BPR and BPRS reports through the Financial Services Authority Reporting System. (8) The submission of BPR and BPRS reports as referred to in paragraph (7) must be done no later than 3 (three) working days after the submission deadline, accompanied by a notification letter to the Financial Services Authority and supporting documents. (9) BPRs and BPRSs remain responsible for BPR and BPRS reports submitted offline as referred to in paragraph (3) and paragraph (5).
Article 4
The Financial Services Authority may establish different submission deadlines for BPR and BPRS reports through the Financial Services Authority Reporting System than the standard reporting deadlines if specific conditions occur.
Article 5
BPRs and BPRSs experiencing bankruptcy conditions such that they cannot submit BPR and BPRS reports through the Financial Services Authority Reporting System as referred to in Article 2 paragraph (2) and offline as referred to in Article 3 paragraph (3) and paragraph (5) until the submission deadline, must notify the Financial Services Authority in writing to obtain an extension of the submission deadline for BPR and BPRS reports.
Article 6
BPRs and BPRSs are deemed to have submitted BPR and BPRS reports on the date the BPR and BPRS reports are received by the Financial Services Authority.
Article 7
(1) BPRs and BPRSs are required to designate and submit the name of the person responsible for BPR and BPRS reports to the Financial Services Authority.
(2) The name of the person responsible for BPR and BPRS reports as referred to in paragraph (1) must be submitted for the first time via letter no later than:
a. April 30, 2019 for BPRs; and b. September 30, 2019 for BPRSs, calculated based on the date the letter is received by the Financial Services Authority.
(3) BPRs and BPRSs are required to report any changes in the name of the person responsible for BPR and BPRS reports to the Financial Services Authority no later than 10 (ten) days before the change in the name of the person responsible for BPR and BPRS reports. (4) In the event of a vacancy in the person responsible for BPR and BPRS reports, BPRs and BPRSs are required to designate a replacement for the person responsible for BPR and BPRS reports. (5) BPRs and BPRSs are required to report to the Financial Services Authority regarding the replacement of the person responsible for BPR and BPRS reports as referred to in paragraph (4) no later than 1 (one) working day after the replacement of the person responsible for BPR and BPRS reports.
CHAPTER III
BPR MONTHLY REPORTS AND BPRS MONTHLY REPORTS
Article 8
(1) BPR Monthly Reports as referred to in Article 2 paragraph (1) letter a include:
a. basic data; b. balance sheet;
c. administrative accounts;
d. income statement; e. detail lists of specific items in the balance sheet; f. information related to violations and exceedance of maximum credit limits; and g. quarterly financial ratios.
(2) BPRS Monthly Reports as referred to in Article 2 paragraph (1) letter b include:
a. basic data; b. balance sheet;
c. administrative accounts;
d. income statement; e. detail lists of specific items in the balance sheet; f. weekly cash ratio reports; g. information related to violations and exceedance of maximum fund disbursement limits; h. quarterly financial ratios;
i. detail lists of financing restructuring;
j. detail lists of sources and disbursement of zakat and waqf funds; k. detail lists of sources and use of charitable funds; and
l. detail lists of profit-sharing distribution.
(3) BPR Monthly Reports and BPRS Monthly Reports as referred to in paragraph (1) and paragraph (2) must include consolidated information of all offices and information for each individual BPR and BPRS office. (4) BPR Monthly Reports and BPRS Monthly Reports as referred to in paragraph (3) must be prepared in accordance with the guidelines for preparing BPR Monthly Reports and BPRS Monthly Reports. (5) In the event of errors in submitted BPR Monthly Reports and BPRS Monthly Reports, BPRs and BPRSs are required to submit corrections to BPR Monthly Reports and BPRS Monthly Reports through the Financial Services Authority Reporting System by complying with the provisions in paragraph (1) through paragraph (4). (6) Further provisions regarding the guidelines for preparing BPR Monthly Reports and BPRS Monthly Reports as referred to in paragraph (4) are contained in a Financial Services Authority Circular.
Article 9
The provisions as referred to in Article 3 through Article 6 apply mutatis mutandis in the event of corrections to BPR Monthly Reports and BPRS Monthly Reports.
Article 10
BPRs and BPRSs are required to have a conversion system and procedures documented in a written guideline.
Article 11
If the business license of BPRs and BPRSs is revoked due to merger or consolidation, BPRs and BPRSs remain required to submit BPR Monthly Reports and BPRS Monthly Reports for the data of the last month of the report before the merger or consolidation license becomes effective from the Financial Services Authority and the competent institution based on Law.
CHAPTER IV
PERIOD OF SUBMISSION OF BPR MONTHLY REPORTS AND BPRS MONTHLY REPORTS
Article 12
(1) BPRs and BPRSs are required to submit BPR Monthly Reports and BPRS Monthly Reports no later than the 10th of the following month after the reporting month.
(2) If the 10th date as referred to in paragraph (1) falls on a Saturday, Sunday, or public holiday, the submission deadline for BPR Monthly Reports and BPRS Monthly Reports through the Financial Services Authority Reporting System remains on the 10th.
Article 13
(1) BPRs and BPRSs are required to submit corrections to BPR Monthly Reports and BPRS Monthly Reports as referred to in Article 8 paragraph (5) no later than the 15th of the following month after the reporting month. (2) If the 15th date as referred to in paragraph (1) falls on a Saturday, Sunday, or public holiday, the submission deadline for corrections to BPR Monthly Reports and BPRS Monthly Reports through the Financial Services Authority Reporting System remains on the 15th. (3) BPRs and BPRSs may submit corrections to BPR Monthly Reports and BPRS Monthly Reports after the submission deadline for corrections to BPR Monthly Reports and BPRS Monthly Reports as referred to in paragraph (1) until the end of the following month after the reporting month. (4) BPRs and BPRSs are deemed to have submitted corrections to BPR Monthly Reports and BPRS Monthly Reports on the date the corrections to BPR Monthly Reports and BPRS Monthly Reports are received by the Financial Services Authority.
Article 14
(1) If, based on research and/or examination by the Financial Services Authority of BPR Monthly Reports and BPRS Monthly Reports, errors are found, BPRs and BPRSs are required to submit corrections to BPR Monthly Reports and BPRS Monthly Reports for the positions of BPR Monthly Reports and BPRS Monthly Reports since the discovery of the errors. (2) Corrections to BPR Monthly Reports and BPRS Monthly Reports as referred to in paragraph (1) must be submitted no later than 10 (ten) days from the date of notification by the Financial Services Authority or from the date of the final meeting between the board of directors and/or board of commissioners of BPRs and BPRSs with the Financial Services Authority to discuss the examination results (exit meeting). (3) BPRs and BPRSs are required to use the results of research and/or examination as referred to in paragraph (1) to prepare BPR Monthly Reports and BPRS Monthly Reports.
Article 15
(1) If BPRs and BPRSs do not submit BPR Monthly Reports and BPRS Monthly Reports until the deadline as referred to in Article 3 paragraph (4), paragraph (6), paragraph (8), Article 4, or Article 12 paragraph (1), BPRs and BPRSs are deemed to have submitted BPR Monthly Reports and BPRS Monthly Reports late. (2) If BPRs and BPRSs do not submit corrections to BPR Monthly Reports and BPRS Monthly Reports until the deadline as referred to in Article 9, Article 13 paragraph (1), or Article 14 paragraph (2), BPRs and BPRSs are deemed to have submitted corrections to BPR Monthly Reports and BPRS Monthly Reports late. (3) BPRs and BPRSs that do not submit BPR Monthly Reports and BPRS Monthly Reports after the deadline as referred to in paragraph (1), and corrections to BPR Monthly Reports and BPRS Monthly Reports after the deadline as referred to in paragraph (2), remain required to submit BPR Monthly Reports and BPRS Monthly Reports and corrections to BPR Monthly Reports and BPRS Monthly Reports.
CHAPTER V
RECORDING OF BPR MONTHLY REPORTS AND BPRS MONTHLY REPORTS
Article 16
BPRs and BPRSs are required to record business activities based on the financial accounting standards for BPRs and BPRSs.
CHAPTER VI
ADMINISTRATIVE SANCTIONS
Article 17
(1) BPRs and BPRSs deemed to have submitted BPR Monthly Reports and BPRS Monthly Reports late as referred to in Article 15 paragraph (1) shall be subject to administrative sanctions in the form of fines of:
a. IDR 100,000.00 (one hundred thousand rupiah) per day of delay and a maximum of IDR 3,000,000.00 (three million rupiah) for BPRs and BPRSs with core capital less than IDR 50,000,000,000.00 (fifty billion rupiah); or b. IDR 250,000.00 (two hundred fifty thousand rupiah) per day of delay and a maximum of IDR 7,500,000.00 (seven million five hundred thousand rupiah) for BPRs and BPRSs with core capital of at least IDR 50,000,000,000.00 (fifty billion rupiah). (2) BPRs and BPRSs deemed to have submitted corrections to BPR Monthly Reports and BPRS Monthly Reports late as referred to in Article 15 paragraph (2) shall be subject to administrative sanctions in the form of fines of:
a. IDR 100,000.00 (one hundred thousand rupiah) per day of delay for BPRs and BPRSs with core capital less than IDR 50,000,000,000.00 (fifty billion rupiah); or b. IDR 250,000.00 (two hundred fifty thousand rupiah) per day of delay for BPRs and BPRSs with core capital of at least IDR 50,000,000,000.00 (fifty billion rupiah). (3) The calculation of fines per day of delay as referred to in paragraph (1) and paragraph (2) refers to the provisions regarding the deadline for late submission of BPR Monthly Reports and BPRS Monthly Reports as referred to in Article 3 paragraph (4), paragraph (6), paragraph (8), Article 4, and Article 12 paragraph (1) as well as the provisions regarding the deadline for late submission of corrections to BPR Monthly Reports and BPRS Monthly Reports as referred to in Article 9, Article 13 paragraph (1), and Article 14 paragraph (2). (4) For each error in BPR Monthly Reports and BPRS Monthly Reports found based on research and/or examination by the Financial Services Authority as referred to in Article 14 paragraph (1), a fine sanction of IDR 20,000.00 (twenty thousand rupiah) per item shall be imposed and a maximum of:
a. IDR 2,000,000.00 (two million rupiah) for BPRs and BPRSs with core capital less than IDR 50,000,000,000.00 (fifty billion rupiah); or b. IDR 5,000,000.00 (five million rupiah) for BPRs and BPRSs with core capital of at least IDR 50,000,000,000.00 (fifty billion rupiah). (5) In the event of errors in BPR Monthly Reports and BPRS Monthly Reports based on the results of research and/or examination by the Financial Services Authority as referred to in paragraph (4), sanctions are only imposed for errors in the data for the reporting month at the position of the research and/or examination.
Article 18
BPRs and BPRSs that do not comply with the provisions as referred to in Article 2 paragraph (2), Article 7, Article 8 paragraph (3), paragraph (4), paragraph (5), Article 10, Article 11, Article 14 paragraph (1), Article 14 paragraph (3), Article 15 paragraph (3), and Article 16 shall be subject to administrative sanctions in the form of:
a. written reprimands; and/or b. downgrade of health rating.
Article 19
BPRs and BPRSs deemed:
a. late in submitting BPR Monthly Reports and BPRS Monthly Reports as referred to in Article 15 paragraph (1); b. late in submitting corrections to BPR Monthly Reports and BPRS Monthly Reports as referred to in Article 15 paragraph (2); and/or
c. committing errors in BPR Monthly Reports and BPRS Monthly Reports based on research and/or examination by the Financial Services Authority as referred to in Article 14 paragraph (1),
besides being subject to fine sanctions as referred to in Article 17, shall also be subject to administrative sanctions in the form of written reprimands and/or downgrade of health rating as referred to in Article 18.
Article 20
Members of the board of directors, members of the board of commissioners, and/or employees of BPRs and BPRSs who violate the provisions as referred to in Article 16 and/or commit acts of unfair transaction manipulation may be subject to sanctions in accordance with Laws concerning banking and sharia banking.
Article 21
The imposition of fine sanctions as referred to in Article 17 paragraph (2) and paragraph (4) is exempted for the submission of corrections to BPR Monthly Reports and BPRS Monthly Reports related to:
a. the implementation of annual audits by public accountants; b. the accountability of Annual Financial Statements to the general meeting of shareholders or general meeting of members; and/or
c. examination by other competent authorities in accordance with Law.
Article 22
In the event of violations of the provisions concerning BPR Monthly Reports and BPRS Monthly Reports and corrections to BPR Monthly Reports and BPRS Monthly Reports up to the reporting position of November 2019, sanctions shall be imposed based on Bank Indonesia Regulation Number 7/51/PBI/2005 concerning Monthly Reports of Rural Banks and Bank Indonesia Regulation Number 7/9/PBI/2005 concerning Monthly Reports of Sharia Rural Banks.
CHAPTER VII
OTHER PROVISIONS
Article 23
BPRs and BPRSs granted business licenses after this Financial Services Authority Regulation comes into force must apply for BPR and BPRS password numbers to the Financial Services Authority.
CHAPTER VIII
TRANSITIONAL PROVISIONS
Article 24
(1) Submission of BPR Monthly Reports and corrections to BPR Monthly Reports through the Financial Services Authority Reporting System begins from the reporting position of May 2019.
(2) Submission of BPRS Monthly Reports and corrections to BPRS Monthly Reports through the Financial Services Authority Reporting System begins from the reporting position of October 2019.
(3) Provisions regarding the submission of BPR Monthly Reports and corrections to BPR Monthly Reports as regulated in Bank Indonesia Regulation Number 7/51/PBI/2005 concerning Monthly Reports of Rural Banks (State Gazette of the Republic of Indonesia Year 2005 Number 145, Supplement to the State Gazette of the Republic of Indonesia Number 4580) remain in force until the reporting position of November 2019. (4) Provisions regarding the submission of BPRS Monthly Reports and corrections to BPRS Monthly Reports as regulated in Bank Indonesia Regulation Number 7/9/PBI/2005 concerning Monthly Reports of Sharia Rural Banks (State Gazette of the Republic of Indonesia Year 2005 Number 19, Supplement to the State Gazette of the Republic of Indonesia Number 4478) remain in force until the reporting position of November 2019.
CHAPTER IX
CLOSING PROVISIONS
Article 25
Provisions regarding sanctions as referred to in Article 17 through Article 19 in this Financial Services Authority Regulation apply since the reporting position of December 2019.
Article 26
Provisions as referred to in Article 22 remain in force if violations are found based on research and/or examination by the Financial Services Authority from the time this Financial Services Authority Regulation comes into force until December 31, 2020.
Article 27
Upon the coming into force of this Financial Services Authority Regulation, the following provisions:
a. Article 12 and Article 13 of Bank Indonesia Regulation Number 7/51/PBI/2005 concerning Monthly Reports of Rural Banks (State Gazette of the Republic of Indonesia Year 2005 Number 145, Supplement to the State Gazette of the Republic of Indonesia Number 4580); and b. Article 16, Article 17, Article 18, and Article 20 of Bank Indonesia Regulation Number 7/9/PBI/2005 concerning Monthly Reports of Sharia Rural Banks (State Gazette of the Republic of Indonesia Year 2005 Number 19, Supplement to the State Gazette of the Republic of Indonesia Number 4478), are declared to remain in force regarding violations in BPR Monthly Reports and BPRS Monthly Reports up to the reporting position of November 2019 that are discovered until December 31, 2020.
Article 28
Provisions regarding:
a. reports on maximum credit limits for rural banks; b. reports on maximum fund disbursement limits for sharia rural financing banks;
c. public financial statements of rural banks;
d. quarterly public financial statements of sharia rural financing banks; e. financing restructuring reports for sharia rural financing banks; and f. business plans and reports on the realization of business plans for rural banks and sharia rural financing banks, which are submitted online as referred to in the provisions of legislation prior to the coming into force of this Financial Services Authority Regulation, are declared to remain in force insofar as they do not conflict with the provisions in this Financial Services Authority Regulation.
Article 29
Upon the coming into force of this Financial Services Authority Regulation:
a. Bank Indonesia Regulation Number 7/51/PBI/2005 concerning Monthly Reports of Rural Banks (State Gazette of the Republic of Indonesia Year 2005 Number 145, Supplement to the State Gazette of the Republic of Indonesia Number 4580); and b. Bank Indonesia Regulation Number 7/9/PBI/2005 concerning Monthly Reports of Sharia Rural Banks (State Gazette of the Republic of Indonesia Year 2005 Number 19, Supplement to the State Gazette of the Republic of Indonesia Number 4478), are revoked and declared invalid.
Article 30
The provisions of Article 17 through Article 19 come into force on January 1, 2020.
Article 31
This Financial Services Authority Regulation comes into force upon being promulgated.

THE FINANCIAL SERVICES AUTHORITY REPORTING SYSTEM
I. GENERAL
Based on Article 34 paragraph (1) of Law Number 7 of 1992 concerning Banking as amended by Law Number 10 of 1998 concerning Amendment to Law Number 7 of 1992 concerning Banking and Article 35 paragraph (2) of Law Number 21 of 2008 concerning Sharia Banking, it is regulated that BPR and BPRS are required to submit to the Financial Services Authority reports on financial position and annual profit/loss calculations and explanations, as well as other periodic reports, within the time and format determined by the Financial Services Authority. In line with the development of information technology and the increasing need for management information systems for supervision of BPR and BPRS, the submission of data and information from BPR and BPRS must be conducted through the Financial Services Authority Reporting System. Submission of reports through the Financial Services Authority Reporting System aims to increase efficiency and effectiveness in supervision as well as data and information analysis related to policy-making by the Financial Services Authority. In light of this, it is necessary to regulate provisions regarding Reporting by Rural Credit Banks and Sharia Rural Financing Banks through the Financial Services Authority Reporting System.

Submission of BPR and BPRS reports through the Financial Services Authority Reporting System is conducted in accordance with the technical instructions for the BPR and BPRS reporting application on the Financial Services Authority Reporting System website. Paragraph (3) What is meant by “responsible for the truthfulness and completeness of the content” is responsible for the completeness, accuracy, timeliness, and integrity of data and information.

What is meant by “technical disruption” is a disruption caused by technical issues resulting in BPR and BPRS being unable to submit reports online, including disruptions to data communication networks, power outages, or disruptions to core banking application providers and/or information technology service providers as referred to in Financial Services Authority Regulation regarding standards for the implementation of information technology for rural credit banks and Sharia rural financing banks. Paragraph (2) It is clear enough. Paragraph (3) What is meant by “submitting BPR and BPRS reports offline” is the submission of reports in the form of data recordings, including flash drives, digital discs, or other data recording or transfer media that have been validated by the system, to the Financial Services Authority office covering the area of the BPR and BPRS head office. Paragraph (4) What is meant by “holiday” is national holidays and joint leave. Paragraph (5) It is clear enough. Paragraph (6) Notification letters accompanied by supporting documents are submitted to the relevant BPR and BPRS supervisor.
