CONCERNING
LICENSING OF MUTUAL FUND SALES AGENT REPRESENTATIVES BY THE GRACE OF THE ALMIGHTY GOD, THE COMMISSIONERS' COUNCIL OF THE FINANCIAL SERVICES AUTHORITY, Considering:
a. that in order to increase the efficiency and optimization of the licensing system for Mutual Fund Sales Agent Representatives and to enhance the professionalism and competence of Mutual Fund Sales Agent Representatives, it is necessary to refine the Financial Services Authority Regulation Number 50/POJK.04/2015 concerning Licensing of Mutual Fund Sales Agent Representatives; b. that in order to improve the quality of licensing services for Mutual Fund Sales Agent Representatives, strategic steps are needed to optimize the licensing system for Mutual Fund Sales Agent Representatives;
c. that based on the considerations referred to in letters a and b, it is necessary to establish a Financial Services Authority Regulation concerning Licensing of Mutual Fund Sales Agent Representatives;
Considering:
CHAPTER I
GENERAL PROVISIONS
Article 1
In this Financial Services Authority Regulation, the following terms are defined as:
CHAPTER II
REQUIREMENTS AND LICENSING OF MUTUAL FUND SALES AGENT REPRESENTATIVES
Article 2
A Mutual Fund Sales Agent Representative must possess a Mutual Fund Sales Agent Representative license from the Financial Services Authority.
Article 3
(1) A Mutual Fund Sales Agent Representative must meet the following requirements:
a. possess a professional certificate as a Mutual Fund Sales Agent Representative organized by a Professional Certification Body; b. have the legal capacity to perform legal acts;
c. have good ethics and morality; and
d. has never committed disgraceful acts and/or been sentenced for proven criminal acts in the financial services sector.
(2) The professional certificate referred to in paragraph (1) letter a may be used for the application for a Mutual Fund Sales Agent Representative license as long as it is not older than 3 (three) years calculated from the date of issuance until the time of the license application. (3) The Professional Certification Body referred to in paragraph (1) must be registered with the Financial Services Authority in accordance with provisions of laws and regulations.
CHAPTER III
PROCEDURE FOR APPLICATION FOR MUTUAL FUND SALES AGENT REPRESENTATIVE LICENSE
Article 4
(1) An application for a Mutual Fund Sales Agent Representative license is submitted by the applicant to the Financial Services Authority according to the format of the Application for Mutual Fund Sales Agent Representative License contained in the Appendix, which is an integral part of this Financial Services Authority Regulation. (2) The application for a Mutual Fund Sales Agent Representative license must be submitted electronically through the Financial Services Authority's licensing system. (3) The procedure for submitting the application for a Mutual Fund Sales Agent Representative license electronically through the Financial Services Authority's licensing system as referred to in paragraph (2) is in accordance with the procedures established by the Financial Services Authority. (4) The application for a Mutual Fund Sales Agent Representative license as referred to in paragraph (1) must be accompanied by the following complete documents:
a. a photocopy of a valid Identity Card or passport; b. a photocopy of the professional certificate as a Mutual Fund Sales Agent Representative issued by a Professional Certification Body registered with the Financial Services Authority;
c. a letter of employment from a financial services institution in Indonesia, for foreign citizens; and
d. a photocopy of a permit to employ foreign labor issued by the competent authority, for foreign citizens working at financial services institutions.
(5) The Mutual Fund Sales Agent Representative license as referred to in paragraph (1) is issued by the Financial Services Authority electronically through the Financial Services Authority's licensing system and/or the applicant's electronic mail address listed in the Financial Services Authority's licensing system if the applicant has met the requirements as referred to in paragraph (4).
Article 5
In processing the application for a Mutual Fund Sales Agent Representative license, the Financial Services Authority is authorized to:
a. conduct an examination of the completeness of documents submitted by the applicant as referred to in Article 4 paragraph (4); and/or b. request information from the applicant, to ensure the fulfillment of requirements as referred to in Article 4.
Article 6
(1) The Mutual Fund Sales Agent Representative license is issued by the Financial Services Authority no later than 14 (fourteen) working days since the receipt of the application for a Mutual Fund Sales Agent Representative license that meets the requirements. (2) In the event that the application for a Mutual Fund Sales Agent Representative license does not meet the requirements upon receipt, no later than 14 (fourteen) working days since the receipt of the application, the Financial Services Authority provides electronic notification through the Financial Services Authority's licensing system to the applicant stating that:
a. the application does not yet meet the requirements; or b. the application is rejected because it does not meet the requirements.
(3) The notification as referred to in paragraph (2) letter a may include:
a. a request to modify documents; b. a request to add information; and/or
c. a request to complete missing requirements.
(4) The applicant must complete the missing requirements required in the notification as referred to in paragraph (2) letter a no later than 21 (twenty-one) working days after the date of the notification.
(5) The submission of complete requirements as referred to in paragraph (4) is considered received by the Financial Services Authority on the date the complete requirements are received in the Financial Services Authority's licensing system. (6) Since the receipt of the complete requirements as referred to in paragraph (5) in the Financial Services Authority's licensing system, the application for a Mutual Fund Sales Agent Representative license is considered newly received by the Financial Services Authority and processed as referred to in paragraph (1). (7) An applicant who does not complete the missing requirements required within the time limit as referred to in paragraph (4) is considered to have cancelled the application for a Mutual Fund Sales Agent Representative license that has been submitted to the Financial Services Authority.
CHAPTER IV
VALIDITY PERIOD AND EXTENSION OF MUTUAL FUND SALES AGENT REPRESENTATIVE LICENSE
Article 7
The Mutual Fund Sales Agent Representative license has a validity period of 3 (three) years in accordance with the date and month of birth of the license holder and may be extended.
Article 8
(1) An application for the extension of a Mutual Fund Sales Agent Representative license as referred to in Article 7 must be submitted to the Financial Services Authority before the validity period of the Mutual Fund Sales Agent Representative license expires, with the earliest deadline being 90 (ninety) days before the validity period of the Mutual Fund Sales Agent Representative license expires. (2) An application for the extension of a Mutual Fund Sales Agent Representative license cannot be made after the validity period of the Mutual Fund Sales Agent Representative license has expired. (3) An application for the extension of a Mutual Fund Sales Agent Representative license as referred to in paragraph (1) is prepared according to the format of the Application for Extension of Mutual Fund Sales Agent Representative License contained in the Appendix, which is an integral part of this Financial Services Authority Regulation, accompanied by the following complete documents:
a. a photocopy of a permit to employ foreign labor issued by the competent authority, for foreign citizens working at financial services institutions; b. a letter of employment from a financial services institution in Indonesia, for foreign citizens; and
c. a photocopy of continuing education documents executed between the start date and the expiration date of the Mutual Fund Sales Agent Representative license.
(4) An application for the extension of a Mutual Fund Sales Agent Representative license must be submitted electronically through the Financial Services Authority's licensing system for the extension of the Mutual Fund Sales Agent Representative license. (5) The extension of the Mutual Fund Sales Agent Representative license as referred to in paragraph (4) is issued by the Financial Services Authority electronically through the Financial Services Authority's licensing system and/or the applicant's electronic mail (email) address listed in the Financial Services Authority's licensing system if the applicant has met the requirements as referred to in paragraph (3). (6) The procedure for submitting the application for the extension of a Mutual Fund Sales Agent Representative license electronically through the Financial Services Authority's licensing system for the extension of the Mutual Fund Sales Agent Representative license as referred to in paragraph (4) is in accordance with the procedures established by the Financial Services Authority.
Article 9
(1) The extension of a Mutual Fund Sales Agent Representative license is issued by the Financial Services Authority no later than 14 (fourteen) working days since the receipt of the application for the extension of a Mutual Fund Sales Agent Representative license that meets the requirements. (2) In the event that the application for the extension of a Mutual Fund Sales Agent Representative license does not meet the requirements upon receipt, no later than 14 (fourteen) working days since the receipt of the application, the Financial Services Authority provides electronic notification through the Financial Services Authority's licensing system to the applicant stating that:
a. the application does not yet meet the requirements; or b. the application is rejected because it does not meet the requirements.
(3) The notification as referred to in paragraph (2) letter a may include:
a. a request to modify documents; b. a request to add information; and/or
c. a request to complete missing requirements.
(4) The applicant must complete the missing requirements required in the notification as referred to in paragraph (2) letter a.
(5) The submission of complete requirements as referred to in paragraph (4) is considered received by the Financial Services Authority on the date the complete requirements are received in the Financial Services Authority's licensing system. (6) An applicant for the extension of a Mutual Fund Sales Agent Representative license who does not complete the missing requirements required before the validity period of the Mutual Fund Sales Agent Representative license expires is considered to have cancelled the application for the extension of a Mutual Fund Sales Agent Representative license that has been submitted to the Financial Services Authority.
Article 10
(1) In the event that the validity period of a Mutual Fund Sales Agent Representative license has expired but the extension application has been submitted to the Financial Services Authority before the validity period of the Mutual Fund Sales Agent Representative license expires, the Mutual Fund Sales Agent Representative license remains valid until there is:
a. approval for the extension of the Mutual Fund Sales Agent Representative license from the Financial Services Authority; or b. electronic notification through the Financial Services Authority's licensing system to the applicant stating that the application is rejected because it does not meet the requirements. (2) In the event that the validity period of a Mutual Fund Sales Agent Representative license has expired but the extension application has been submitted to the Financial Services Authority before the validity period of the Mutual Fund Sales Agent Representative license expires, the Mutual Fund Sales Agent Representative license remains valid during the extension process even if there is electronic notification through the Financial Services Authority's licensing system to the applicant stating that the application does not yet meet the requirements. (3) The approval as referred to in paragraph (1) letter a, the rejection as referred to in paragraph (1) letter b, and the notification as referred to in paragraph (2) are provided by the Financial Services Authority no later than 5 (five) working days since the validity period of the Mutual Fund Sales Agent Representative license expires through the Financial Services Authority's licensing system. (4) The applicant must complete the missing requirements required in the notification as referred to in paragraph (2) no later than 5 (five) working days from the date of the notification. (5) The submission of document changes, additional information, and/or completion of missing requirements as referred to in paragraph (4) is considered received by the Financial Services Authority on the date the document changes, additional information, and/or completion of missing requirements are received in the Financial Services Authority's licensing system. (6) Since the receipt of document changes, additional information, and/or completion of missing requirements as referred to in paragraph (5), the application for a Mutual Fund Sales Agent Representative license is considered newly received by the Financial Services Authority. (7) In the event that document changes, additional information, and/or completion of missing requirements as referred to in paragraph (6) have been received by the Financial Services Authority, within 5 (five) working days the Financial Services Authority provides approval or rejection of the extension of the Mutual Fund Sales Agent Representative license. (8) An applicant who does not complete the missing requirements required within the time limit as referred to in paragraph (4) is considered to have cancelled the application for the extension of a Mutual Fund Sales Agent Representative license that has been submitted to the Financial Services Authority.
Article 11
The validity period of a Mutual Fund Sales Agent Representative license that has received approval for extension is 3 (three) years from the date of approval issued by the Financial Services Authority, and the validity period ends precisely on the date and month of birth of the Mutual Fund Sales Agent Representative license holder.
Article 12
If at the time of the application for the extension of a Mutual Fund Sales Agent Representative license, the holder of the Mutual Fund Sales Agent Representative license still has obligations based on provisions of laws and regulations in the financial services sector and/or decisions of the Financial Services Authority that have not been fulfilled, the Financial Services Authority is authorized to reject the application for the extension of the Mutual Fund Sales Agent Representative license.
CHAPTER V
OBLIGATIONS AND PROHIBITIONS FOR MUTUAL FUND SALES AGENT REPRESENTATIVES First Section Obligations
Article 13
A Mutual Fund Sales Agent Representative must:
a. understand and comply with Indonesian capital markets laws and regulations related to the activity of selling mutual fund securities and other investment products regulated based on provisions of laws and regulations in the field of capital markets; b. act and behave professionally in selling mutual fund securities and other investment products regulated based on provisions of laws and regulations in the field of capital markets; and
c. prioritize the interests and suitability with the financial sources, financial capacity, and investment objectives of prospective customers when conducting activities of selling mutual fund securities and other investment products regulated based on provisions of laws and regulations in the field of capital markets.
Article 14
A Mutual Fund Sales Agent Representative must participate in continuing education organized by the association related to mutual funds at least 1 (one) time in 3 (three) years.
Second Section
Prohibitions
Article 15
A Mutual Fund Sales Agent Representative is prohibited from:
a. performing the functions of a securities company representative; and/or b. providing incorrect or misleading information regarding the sale of mutual fund securities and other investment products regulated based on provisions of laws and regulations in the field of capital markets.
CHAPTER VI
REPORTING
Article 16
(1) The association related to mutual funds as the organizer of continuing education for Mutual Fund Sales Agent Representatives must submit a report on the implementation of continuing education no later than 6 (six) months since the program for continuing education for Mutual Fund Sales Agent Representatives was held, accompanied by supporting evidence. (2) In the event that the deadline for submitting the report as referred to in paragraph (1) falls on a holiday, the report must be submitted no later than 1 (one) working day thereafter. (3) In the event that the Financial Services Authority has provided an electronic system for submitting reports, the report from the organizer of continuing education for Mutual Fund Sales Agent Representatives as referred to in paragraph (1) must be submitted through that electronic system.
CHAPTER VII
RETURN OF MUTUAL FUND SALES AGENT REPRESENTATIVE LICENSE
Article 17
(1) The holder of a Mutual Fund Sales Agent Representative license may return the Mutual Fund Sales Agent Representative license held to the Financial Services Authority electronically through the Financial Services Authority's licensing system using the format for Return of Mutual Fund Sales Agent Representative License according to the Appendix, which is an integral part of this Financial Services Authority Regulation. (2) The return of the Mutual Fund Sales Agent Representative license as referred to in paragraph (1) does not immediately eliminate the obligations and responsibilities regarding provisions of laws and regulations in the financial services sector and/or decisions of the Financial Services Authority that have not been fulfilled arising while the individual held the Mutual Fund Sales Agent Representative license.
CHAPTER VIII
OTHER PROVISIONS
Article 18
In the event of specific circumstances causing the electronic system to function improperly, applications for a Mutual Fund Sales Agent Representative license or applications for the extension of a Mutual Fund Sales Agent Representative license may be submitted in printed document form to the Financial Services Authority.
CHAPTER IX
SANCTION PROVISIONS
Article 19
(1) Every party that violates the provisions as referred to in Article 3, Article 13, Article 14, Article 15, and Article 16 paragraph (1) shall be subject to administrative sanctions.
(2) Sanctions as referred to in paragraph (1) are also imposed on parties causing the violations as referred to in paragraph (1).
(3) Sanctions as referred to in paragraph (1) and paragraph (2) are imposed by the Financial Services Authority.
(4) Administrative sanctions as referred to in paragraph (1) include:
a. written warning; b. fines, namely the obligation to pay a certain amount of money;
c. restriction of business activities;
d. suspension of business activities; e. revocation of business license; f. cancellation of approval; and/or g. cancellation of registration.
(5) Administrative sanctions as referred to in paragraph (4) letter b, letter c, letter d, letter e, letter f, or letter g may be imposed with or without prior imposition of administrative sanctions in the form of a written warning as referred to in paragraph (4) letter a. (6) Administrative sanctions in the form of fines as referred to in paragraph (4) letter b may be imposed separately or together with the imposition of administrative sanctions as referred to in paragraph (4) letter c, letter d, letter e, letter f, or letter g. (7) The procedure for imposing sanctions as referred to in paragraph (3) is carried out in accordance with provisions of laws and regulations.
Article 20
In addition to administrative sanctions as referred to in Article 19 paragraph (4), the Financial Services Authority may take specific actions against any party that violates the provisions of this Financial Services Authority Regulation.
Article 21
The Financial Services Authority may announce the imposition of administrative sanctions as referred to in Article 19 paragraph (4) and specific actions as referred to in Article 20 to the public.
CHAPTER X
TRANSITIONAL PROVISIONS
Article 22
(1) Provisions regarding professional certificates as referred to in Article 3 paragraph (1) letter a shall take effect in accordance with provisions in Financial Services Authority Regulations regarding Professional Certification Bodies registered with the Financial Services Authority. (2) Professional certificates as Mutual Fund Sales Agent Representatives issued by associations related to mutual funds remain valid in accordance with provisions in Financial Services Authority Regulations regarding the registration of Professional Certification Bodies in the field of capital markets.
Article 23
(1) Mutual Fund Sales Agent Representative licenses issued prior to the implementation of this Financial Services Authority Regulation are declared to remain valid for 3 (three) years since the implementation of this Financial Services Authority Regulation. (2) Mutual Fund Sales Agent Representative licenses issued prior to the implementation of this Financial Services Authority Regulation may be applied for extension to the Financial Services Authority within a period of 3 (three) years since the implementation of this Financial Services Authority Regulation based on the date and month of birth of the Mutual Fund Sales Agent Representative license holder. (3) Applications for the extension of Mutual Fund Sales Agent Representative licenses as referred to in paragraph (2) are submitted to the Financial Services Authority with the earliest deadline being 90 (ninety) days before the date and month of birth of the Mutual Fund Sales Agent Representative license holder.
Article 24
The continuing education obligations for Mutual Fund Sales Agent Representatives issued prior to the implementation of this Financial Services Authority Regulation are adjusted to be every 3 (three) years from the date of issuance of the Mutual Fund Sales Agent Representative license.
Article 25
Applications for Mutual Fund Sales Agent Representative licenses submitted to the Financial Services Authority prior to the implementation of this Financial Services Authority Regulation shall be resolved based on Financial Services Authority Regulation Number 50/POJK.04/2015 concerning Licensing of Mutual Fund Sales Agent Representatives.
CHAPTER XI
CLOSING PROVISIONS
Article 26
Upon the implementation of this Financial Services Authority Regulation, Financial Services Authority Regulation Number 50/POJK.04/2015 concerning Licensing of Mutual Fund Sales Agent Representatives (State Gazette of the Republic of Indonesia Year 2015 Number 401, Supplement to the State Gazette of the Republic of Indonesia Number 5819) is repealed and declared invalid.
Article 27
This Financial Services Authority Regulation takes effect on the date of enactment.

CONCERNING
LICENSING OF MUTUAL FUND SALES AGENT REPRESENTATIVES
I. GENERAL
The improvement of Financial Services Authority Regulation Number 50/POJK.04/2015 concerning Licensing of Mutual Fund Sales Agent Representatives is carried out to increase efficiency and optimization of licensing services for Mutual Fund Sales Agent Representatives, enhance the professionalism and competence of Mutual Fund Sales Agent Representatives, and adopt the certification structure for Mutual Fund Sales Agent Representatives through Capital Market Professional Certification Bodies.
A number of efforts taken by the Financial Services Authority to carry out efficiency and optimization of the licensing process for Mutual Fund Sales Agent Representatives include, among others, optimizing the use of electronic systems as a licensing medium and simplifying the completeness of licensing documents for Mutual Fund Sales Agent Representatives.
From the aspect of improving the competence and professionalism of Mutual Fund Sales Agent Representatives, the Financial Services Authority has established a number of behavioral standards that must be carried out by Mutual Fund Sales Agent Representatives, and mandated that every Mutual Fund Sales Agent Representative must attend continuing education at least once every 3 (three) years.
Furthermore, to provide a legal basis for the efforts to be undertaken, it is necessary to improve the Financial Services Authority Regulation Number 50/POJK.04/2015 Concerning Licensing of Mutual Fund Sales Agent Representatives.
