Interagency Guidance Regarding Deposit Reconciliation Practices

2 files · 3 PDF pages

State member banks supervised by the Federal Reserve, including those with total consolidated assets of $10 billion or less, must adopt deposit reconciliation policies to avoid or resolve discrepancies so customers are not disadvantaged. These institutions must comply with the Expedited Funds Availability Act (EFAA) and Regulation CC by making funds available within prescribed limits and providing accurate disclosures and delay notices. Practices resulting in credit discrepancies may violate the Federal Trade Commission Act (FTC Act) or Dodd-Frank Act. To claim bona fide error liability protection, institutions must prove violations were unintentional and not due to a lack of reasonable procedures.
