Subject: New method for reporting occurrences or indications of infractions.
Dear Directors,
a) On January 12, 2026, the Securities and Exchange Commission of Brazil (CVM) published CVM Resolution 239, which created the Superintendence of Market, Derivatives and Systemic Risks Supervision (SMD), which assumed the activity of monitoring the secondary market;
b) CVM Resolution No. 35/2021 requires, in its Article 33, item IV, that intermediaries inform the CVM whenever they verify the occurrence or indications of possible violations of legislation whose supervision is the responsibility of the CVM;
c) Joint Circular No. 06/2015/CVM/SMI guided intermediaries to use the email address smiviolacao@cvm.gov.br to comply with the aforementioned provision;
d) Communication by email has become obsolete and inefficient, mainly after the digitalization of administrative processes;
The Superintendence of Market and Intermediaries Relations - SMI and the Superintendence of Market, Derivatives and Systemic Risks Supervision - SMD announce the new method for communicating the occurrence or identification of occurrences or indications of possible violations of legislation whose supervision is the responsibility of the CVM: From this document onwards, the aforementioned communications must be filed directly on the Authority's website, through the digital protocol system.
Sending communications through the digital protocol is safer for the participant, who immediately receives proof of submission, and for SMI and SMD, as the protocol system allows for the automated insertion of documents into the administrative process necessary for investigation, already directing the communication to the responsible area, in addition to mitigating potential operational errors. Thus, this change aims to guarantee greater efficiency, speed in processing, cost-effectiveness, and information security.
We also inform that it is recommended that, during the filing, the participant direct the communication to the superintendence or management responsible for the investigation, if they can identify it.
In particular, indications of infractions related to:
5.1. The activity of intermediaries, such as possible violations of CVM Resolution 35/21, must be sent to the Intermediaries Supervision Management 1 (GSUI-1/SMI);
5.2. The conduct of investment advisers must be sent to the Intermediaries Supervision Management 2 (GSUI-2/SMI); and
5.3. Operations involving trading in the secondary market for securities (CVM Resolution 62/22) or trading based on inside information (Article 27-D of Law 6.385/76), must be sent to the Market Monitoring Management (GMA/SMD).
