Matters Requiring Attention for Violations of Laws and Regulations

This proposed rule would amend 12 CFR Part 4 to limit the issuance of matters requiring attention (MRAs) to "substantive violations" of laws or regulations, establishing a separate mechanism for technical violations. A substantive violation is defined as one whose nature, duration, frequency, or severity could meaningfully impact the institution or its customers, divided into five categories comprising systemic patterns, impacts on financial condition, impacts on books and records, customer harm requiring restitution, and insider misconduct. The standards apply to national banks, Federal savings associations, and Federal branches and agencies of foreign banks, with examiners retaining discretion to use less formal supervisory mechanisms for violations not meeting the substantive criteria. Comments on the proposal must be received within 30 days of publication in the Federal Register.
