Membership of State Banking Institutions in the Federal Reserve System; Reports of Suspicious Activities Under Bank Secrecy Act

The Board proposes to amend its Suspicious Activity Report regulations to expressly provide for the issuance of exemptions from SAR requirements, in full or in part, subject to Board approval. This proposal applies to state member banks, Edge and agreement corporations, U.S. offices of foreign banking organizations supervised by the Federal Reserve, and bank holding companies and their nonbank subsidiaries. The Board would determine whether an exemption is consistent with safe and sound banking, seeking FinCEN’s concurrence for exemptions involving potential money laundering or BSA violations. Comments on the proposal must be received by February 22, 2021.
