NORMATIVE INSTRUCTION BCB NO. 379, OF MAY 12, 2023

Establishes procedures for the packaging and forwarding to the Central Bank of Brazil of counterfeit national or foreign banknotes or coins seized by judicial or police agencies.

The Head of the Circulating Medium Department (Mecir), in the exercise of the powers conferred upon him by Art. 23, items XVII and XVIII, of the Internal Regulations of the Central Bank of Brazil, in view of the provisions of Art. 4, item X, of Resolution No. 780, of August 8, 2022, of the Federal Justice Council (CJF),

resolves:

Art. 1. This Normative Instruction establishes the procedures for the packaging and forwarding to the Central Bank of Brazil (BCB) of counterfeit national or foreign banknotes or coins seized by judicial or police agencies.

Art. 2. The Circulating Medium Department (Mecir) will maintain the activity of safeguarding counterfeit banknotes or coins, national or foreign, including extinct monetary standards, to meet the demands of judicial or police agencies.

Sole Paragraph. Copies of counterfeit national or foreign banknotes or coins will be kept under safeguard until there is a determination by a competent authority regarding their destination.

Art. 3. Copies of counterfeit national or foreign banknotes or coins must be packaged in transparent security envelopes, closed, identified, and sealed by the sending institution, without smudges and without signs of unauthorized opening.

Sole Paragraph. In the event of non-compliance with the requirements set forth in the main text, the receipt may be refused.

Art. 4. The handling of the safeguarding operations referred to in Art. 2 will be carried out at the representations of the Central Bank of Brazil, according to the area of operation of each, described in a specific communication, and must be scheduled in advance, by means of a request to be sent to the electronic addresses related in Art. 8 of this Normative Instruction.

Art. 5. To receive counterfeit national or foreign banknotes or coins, the sending institution must forward an official letter signed by the competent public authority, free of smudges, containing the specification and individualization of the items to be safeguarded.

Art. 6. The receipt of the volumes to be safeguarded will be recorded in the Central Bank of Brazil's control system, and the presenter will be provided with a document proving the receipt of the sealed volumes.

Art. 7. Mecir will proceed with the destruction of safeguarded counterfeit copies, national or foreign, provided that there is:

I - a specific judicial order for the respective safeguarded volume; or

II - a determination by the competent public authority or the Public Ministry, when the seizure did not generate a judicial action.

Art. 9. Normative Instruction BCB No. 67, of December 31, 2020, is hereby revoked.

Art. 10. This Normative Instruction enters into force on the date of its publication.
