Rule · BCB · 9 Jul 2024 · Instrução Normativa BCB 489
This instruction amends Circular Letter No. 3,869 of 2018 to introduce document code 3042 for correcting Credit Risk Data (code 3040) submissions to the Credit Information System (SCR). Financial institutions may now submit partial corrections via code 3042, through the SCR Management Panel, or by resubmitting a new code 3040 document, provided corrections are made within twenty-four base dates after the original submission. The regulation becomes effective on the date of its publication, aiming to reduce operational costs for financial institutions by allowing more efficient error correction.
NORMATIVE INSTRUCTION BCB NO. 489, OF JULY 9, 2024
Amends Circular Letter No. 3,869, of March 19, 2018, which amends and consolidates the procedures to be observed in the submission of information to the Credit Information System (SCR), as provided for in Circular No. 3,870, of December 19, 2017.
The Head of the Financial System Monitoring Department (Desig), using the authority granted to him by Art. 23, item I, letter “a”, of the Internal Regulations of the Central Bank of Brazil, annexed to Resolution BCB No. 340, of September 21, 2023, considering the provisions of Art. 85, item I, letter “b”, of said Regulations and based on the provisions of Circular No. 3,870, of December 19, 2017,
R E S O L V E S:
Art. 1º Circular Letter No. 3,869, of March 19, 2018, shall enter into force with the following alterations:
“Art. 2º

“Art. 14.
....................................................................................................................

NOTE
The Credit Information System (SCR) is a system in which credit operations of clients are registered, as provided for in Art. 3º of CMN Resolution No. 5,037, of September 29, 2022. The financial institutions mentioned in said Resolution must provide such information in order to fulfill the functions of the SCR provided for in its Art. 2º, in accordance with Circular No. 3,870, of December 19, 2017.
Credit information must be forwarded through document code 3040 - Credit Risk Data, in an aggregated or individualized manner. The credit data of the client whose direct risk at the financial institution (sum of credit operations, interfinancial transfers, co-obligations and limits, credits to be released) is equal to or greater than two hundred reais must be registered in an individualized manner. If the value is less than two hundred reais, the information must be registered in an aggregated manner, without identification of the debtor.
If any error is found in the transmitted information, the institution currently has two ways to correct the irregularity:
I - making point corrections, via web, through the SCR Management Panel, available at the electronic address on the internet http://www.bcb.gov.br/?SCR; or
II - forwarding a new document 3040, which, after processing, replaces the previously sent one.
Point corrections are used by institutions when the volume of information to be corrected is relatively limited. If there is a substantial volume of information, institutions opt to forward a new document 3040. However, there are cases where the volume of information is considerable for making point corrections, but the total replacement of the file is not justified. To resolve this issue, document code 3042 - Correction of document 3040 is being created, to allow institutions to forward a document with partial corrections of the information sent in an individualized manner, facilitating the sending and, consequently, reducing the operational costs of such corrections. It should be noted that in addition to alterations of the sent information, exclusions of credit operations sent inappropriately and inclusion of operations that should have been sent but were not, can be made.
It is also proposed that this regulation enters into force on the date of its publication, considering that the document now created, by offering another option for correcting irregularities, aims to facilitate the work of institutions in generating the file, with the consequence of reducing costs.
Therefore, this Normative Instruction aims to amend Circular Letter No. 3,869, of 2018, in order to:
I - create document code 3042 - Correction of document 3040, with transmission starting from the date of entry into force; and
II - specify the information, the form and the deadline for sending this document.
Decree No. 10,411, of June 30, 2020, regulates the realization of regulatory impact analysis (RIA) as a prerequisite for the issuance of normative acts. However, in its article 4º, said decree establishes the hypotheses for exemption from the realization of RIA. This BCB IN falls within the hypotheses provided for in items III and VII, namely: III - normative act considered of low impact; and VII - normative act that reduces requirements, obligations, restrictions, requests or specifications with the objective of reducing regulatory costs.
Considering that document code 3042 - Correction of document 3040 - will be used by institutions to send individualized corrections of credit data, it is understood that the creation of this document represents the simplest and lowest cost implementation method, both for institutions and for this Central Bank, which justifies its inclusion in item III of Art. 4º of said Decree. Finally, the inclusion of this normative act in item VII of the cited Decree is justified, since the new document will allow the transmission of corrected data more efficiently, generating cost reduction, as discussed in paragraphs four and five.
In light of the above and based on paragraphs seven and eight, I understand that this normative instruction is exempt from the realization of RIA.
