PS23/11: Guidance on the trading venue perimeter
The document issues new Questions and Answers in Chapter 13 of the Perimeter Guidance manual (PERG) to clarify the definition of a multilateral system and its application to specific arrangements. It sets aside ESMA’s market structures Q&As 7, 10, 11, and 12 so they no longer form part of supervisory expectations, and updates the Glossary definition of a service company to reference current client categorisation terminology. The final guidance comes into force on 9 October 2023, requiring firms to assess whether their activities constitute a multilateral system and hold appropriate regulatory permissions.
