The opening, in the country, of branches of financial institutions domiciled abroad or under direct or indirect foreign capital control, which implies an increase in the number existing on 05.10.88, is conditioned to the promulgation of the complementary law provided for in Art. 192 of the Federal Constitution, observing the provisions of the sole paragraph of Art. 52 of the Transitory Constitutional Provisions Act.
Art. 18. The installation of a Banking Service Post (PAB) in an underserved municipality, Banking Collection and Payments Post (PAP), Advanced Rural Credit Post (PACRE), Savings Shop, and Consumer Credit Shop will no longer be permitted, observing, regarding those existing on the date of publication of this Regulation, that:
I - must continue to provide only services for which they were created;
II - if they are to be closed, they may not be reopened;
III - may not change address.
Art. 19. The authorization referred to in Art. 12 and the communication referred to in Art. 15 of this Regulation must be requested and carried out, respectively, in writing, while the corresponding SISBACEN transactions are not available.
ANNEX IV REGULATION TO RESOLUTION NO. 2,099, OF 17.08.94, WHICH ESTABLISHES THE OBLIGATION OF MAINTENANCE, BY FINANCIAL INSTITUTIONS AND OTHER INSTITUTIONS AUTHORIZED TO OPERATE BY THE CENTRAL BANK OF BRAZIL, OF ADJUSTED NET WORTH VALUE IN ACCORDANCE WITH CURRENT REGULATION, COMPATIBLE WITH THE RISK LEVEL OF THEIR ASSET STRUCTURE.
Art. 1. Financial institutions and other institutions authorized to operate by the Central Bank of Brazil, except credit cooperatives, in addition to the minimum levels of paid-in capital and net worth established in Annex II, must maintain a value of adjusted net worth compatible with the risk level of their asset structure.
Sole paragraph. The obtaining of the value referred to will take into consideration the weighting of the institution's active operations by the risk attributed to them.
Art. 2. The calculation of the adjusted net worth value referred to in the previous article will follow the following formula:
PLE = 0.08 (Apr), where:
PLE = required net worth as a function of the risk of active operations;
Apr = Risk-weighted Assets = total of the product of Current and Long-Term Realizable titles (COSIF code 1.0.0.00.00-7) by the corresponding risk factors + product of Permanent Assets (COSIF code 2.0.0.00.00-4) by the corresponding risk factor + product of titles of Sub-obligations and Risks in Guarantees Provided (COSIF code 3.0.1.00.00-4) by the corresponding risk factors.
Paragraph 1. The risks of operations will be classified according to the factors contained in the table annexed to this Regulation.
Paragraph 2. The Central Bank of Brazil is authorized to alter the table referred to in the previous paragraph, as well as assign risk factors to new accounting titles created in COSIF.
Paragraph 3. Any alteration of the calculation methodology, risk factors, or inclusion of a title in the table mentioned in Paragraph 1 that results in a greater requirement for net worth will imply granting an adaptation period of no less than 180 (one hundred and eighty) days.
Art. 3. For the purpose of verifying compliance with the condition established in Art. 1 of this Regulation, the amount of participations in the social capital of financial institutions and other institutions authorized to operate by the Central Bank of Brazil, as well as the value of investments made in corporate participations in financial institutions abroad, must be deducted from the respective adjusted net worth, adjusted in accordance with current regulation.
Art. 4. Financial institutions and other institutions authorized to operate by the Central Bank of Brazil that are part of a conglomerate are alternatively entitled, to the provisions of the previous article, to calculate the value of net worth in a consolidated manner, adjusted in accordance with current regulation.
Paragraph 1. For the purposes of this article, the concept of conglomerate adopted by the Accounting Plan of Institutions of the National Financial System (COSIF) must be used.
Paragraph 2. The option to use the facility referred to in this article must be the subject of deliberation in an extraordinary general meeting of each of the institutions comprising the conglomerate and:
I - implies the obligation to communicate the decision to the Central Bank of Brazil;
II - occurs without prejudice to the obligation to proceed with the deductions referred to in the previous article, regarding institutions not part of the conglomerate;
III - may only be reviewed from the exercise following the option and provided that the content of the corresponding decision is communicated to the Central Bank of Brazil at least 1 (one) month in advance.
Art. 5. The institutions referred to in Art. 1 will have until 31.12.94 to adapt their respective net worth values to the conditions established in this Regulation.
