Resolution of the General Intendancy of Supervision of Entities

WHEREAS:

File No. 2024026338 initiated by Scotia Fondos Sociedad Administradora de Fondos Mutuos S.A., as well as Report No. 1008-2024-SMV/10.2 of 01 August 2024, of the General Intendancy of Supervision of Entities of the Superintendency of the Market in Securities;

CONSIDERING:

That, by means of writings submitted up to 25 July 2024, Scotia Fondos Sociedad Administradora de Fondos Mutuos S.A. requested the Superintendency of the Market in Securities to register the mutual funds for investment in securities denominated "Scotia Fondo Mediano Plazo Flex S/ FMIV" and "Scotia Fondo Mediano Plazo Flex $ FMIV", in the corresponding section of the Public Registry of the Securities Market;

That, from the evaluation of the documentation submitted, it has been determined that Scotia Fondos Sociedad Administradora de Fondos Mutuos S.A. has complied with the provisions of: (i) articles 37, 38 and 39 of the Regulation of Mutual Funds for Investment in Securities and their Management Companies, approved by Conasev Resolution No. 068-2010-EF/94.01.1 and its amendments; (ii) Superintendency Resolution No. 155-2018-SMV/02; (iii) the Single Text of Administrative Procedures of the Superintendency of the Market in Securities, approved by Superintendency Resolution No. 023-2015-SMV/02, as developed in Report No. 1008-2024-SMV/10.2; and,

In accordance with the provisions of article 1, subsection b), of the Single Concorded Text of the Organic Law of the Superintendency of the Market in Securities, approved by Decree Law No. 26126 and its amending norms; as well as article 38, numerals 6) and 7) of the Regulation of Organization and Functions of the Superintendency of the Market in Securities, approved by Supreme Decree No. 216-2011-EF and its amendments;

RESOLVES:

Article 1.- To order the registration of the mutual funds for investment in securities denominated "Scotia Fondo Mediano Plazo Flex S/ FMIV" and "Scotia Fondo Mediano Plazo Flex $ FMIV", their respective simplified prospectuses and annexes of the participation regulation, in the corresponding section of the Public Registry of the Securities Market.

Article 2.- The registration referred to in article 1 of this resolution does not imply that the Superintendency of the Market in Securities recommends the subscription of units of the aforementioned mutual funds for investment in securities or expresses a favorable opinion on their profitability or quality.

Article 3.- Scotia Fondos Sociedad Administradora de Fondos Mutuos S.A. must send to the Superintendency of the Market in Securities the updated version of the simplified prospectus and the annex of the participation regulation, including the effective date, as well as the update of the reference to the resolution approving the fund, within a period no greater than ten (10) business days from the notification of this resolution.

Article 4.- To order the dissemination of this resolution on the Securities Market Portal of the Superintendency of the Market in Securities (www.gob.pe/smv).

Article 5.- To transcribe this resolution to Scotia Fondos Sociedad Administradora de Fondos Mutuos S.A. and to Scotiabank Perú S.A.A., in its capacity as custodian.
