SEEN:

Joint Report No. 94-2015-SMV/06/07 of 11 February 2015, issued by the Office of Legal Advice and by the Office of Planning and Budget, and the draft Unified Text of Administrative Procedures – TUPA of the Superintendency of the Securities Market – SMV;

CONSIDERING:

That, by means of Superintendent's Resolution No. 146-2014-SMV/02 of 30 December 2014, the latest update of the Unified Text of Administrative Procedures - TUPA of the Superintendency of the Securities Market – SMV was approved;

That, by means of SMV Resolution No. 029-2014-SMV/01 and Superintendent's Resolution No. 142-2014-SMV/02, both of 21 December 2014, the Regulation on Investment Funds and their Management Companies and the Regulation on Structuring Entities of the Securities Market were approved, respectively;

That, on 30 December 2014, Supreme Decree No. 374-2014-EF was published in the Official Gazette El Peruano, which established the value of the Tax Unit (UIT) for the year 2015;

That, Law No. 30230, Law establishing tax measures, simplification of procedures and permits for the promotion and dynamization of investment in the country, published on 12 July 2014, provides that public administration entities are obliged to make the corresponding modifications in their respective TUPA, in the event that the rules establish or modify the requirements, deadlines or administrative silence applicable to administrative procedures;

That, in compliance with the rules indicated in the preceding paragraphs, a TUPA has been prepared that incorporates new procedures, adapts previous procedures and makes some adjustments resulting from the review of the other administrative procedures of the TUPA in force;

That, according to the provisions of item 21 of Article 3° of the Unified Harmonized Text of the Organic Law of the SMV, approved by Supreme Decree Law No. 26126 and amended by Law No. 29782, it is the responsibility of the Superintendent of the Securities Market to approve the institutional TUPA; and,

In accordance with the provisions of Article 38 of Law No. 27444, Law of the General Administrative Procedure; Article 3º, item 21, of the Unified Harmonized Text of the Organic Law of the SMV, approved by Supreme Decree Law No. 26126 and amended by Law No. 29782, Law for the Strengthening of the Superintendency of the Securities Market; as well as in Superintendent's Resolution No. 015-2015-SMV/02 of 29 January 2015;

RESOLVES:

Article 1°.- To approve the “Unified Text of Administrative Procedures – TUPA of the Superintendency of the Securities Market – SMV”, the text of which is annexed to this resolution.

Article 2°.- This resolution shall enter into force the day after its publication.

Article 3°.- To publish this resolution in the Official Gazette El Peruano and on the Securities Market Portal (www.smv.gob.pe).

Article 4º.- The annex referred to in Article 1º of this resolution shall be published on the Citizen and Business Services Portal – PSCE (www.serviciosalciudadano.gob.pe) and on the Securities Market Portal of the Superintendency of the Securities Market (www.smv.gob.pe), in accordance with item 38.3 of Article 38 of Law No. 27444 – Law of the General Administrative Procedure and item 3.1 of Article 3° of Supreme Decree No. 004-2008-PCM.
