Resolution of the General Intendancy of Supervision of Entities

The General Intendant of Supervision of Entities

WHEREAS:

File No. 2024037108 initiated by Scotia Fondos Sociedad Administradora de Fondos Mutuos S.A., as well as Report No. 1350-2024-SMV/10.2 dated 16 October 2024, from the General Intendancy of Supervision of Entities of the Superintendency of the Securities Market;

CONSIDERING:

That, by writings submitted up to 4 October 2024, Scotia Fondos Sociedad Administradora de Fondos Mutuos S.A. requested the Superintendency of the Securities Market to register amendments to the simplified prospectus and annex to the participation regulations of the mutual fund for investment in securities called “Scotia Fondo de Fondos Distributivo HY FMIV”;

That the changes refer to the establishment of a defined term of validity of the FUND and the incorporation of its liquidation procedure;

That, from the evaluation of the documentation submitted, it has been determined that Scotia Fondos Sociedad Administradora de Fondos Mutuos S.A. complies with the provisions of: (i) article 55 of the Regulation of Mutual Funds for Investment in Securities and their Management Companies and its amendments; (ii) the Single Text of Administrative Procedures of the Superintendency of the Securities Market, approved by Superintendent Resolution No. 023-2015-SMV/02, as developed in Report No. 1350-2024-SMV/10.2; and,

In accordance with the provisions of article 38, numeral 6, of the Regulation of Organization and Functions of the Superintendency of the Securities Market, approved by Supreme Decree No. 216-2011-EF and its amendments.

RESOLVES:

Article 1.- To approve the registration of the amendments to the simplified prospectus and to the annex to the participation regulations of the mutual fund for investment in securities called “Scotia Fondo de Fondos Distributivo HY FMIV” in the corresponding section of the Public Registry of the Securities Market.

Article 2.- The amendments to the simplified prospectus and annex to the participation regulations indicated in article 1 above enter into force on 28 October 2024.

Article 3.- To order the dissemination of this resolution on the Securities Market Portal of the Superintendency of the Securities Market (www.gob.pe/smv).

Article 4.- To transcribe this resolution to Scotia Fondos Sociedad Administradora de Fondos Mutuos S.A. and to Scotiabank Perú S.A.A., in its capacity as custodian.
