WHEREAS:

File No. 2024003538 initiated by AC Capitales Sociedad Administradora de Fondos de Inversión S.A., as well as Report No. 224-2024-SMV/10.2 dated 22 February 2024 from the General Superintendency of Supervision of Entities of the Superintendency of the Market in Securities;

CONSIDERING:

That, on 18 April 2018, the investment fund named "Fondo de Inversión en Rentas de Bienes Inmuebles (FIRBI) – AC Capitales Renta" (hereinafter, the FUND) managed by AC Capitales Sociedad Administradora de Fondos de Inversión S.A. was registered under the Simplified Regime in the corresponding section of the Public Registry of the Securities Market (hereinafter, RPMV);

That, by Resolution of the General Superintendency of Supervision of Entities No. 123-2018-SMV/10.2 dated 30 October 2018, the registration of amendments to the FUND's Participation Regulations was ordered, as well as the consequent change of the FUND to the General Regime, in the corresponding section of the RPMV;

That, by writings submitted up to 19 February 2024, AC Capitales Sociedad Administradora de Fondos de Inversión S.A. requested the registration of an amendment to article 9 of the FUND's Participation Regulations in the RPMV, referring to the term of duration and expiration of the FUND;

That, from the evaluation of the documentation submitted, it has been determined that AC Capitales Sociedad Administradora de Fondos de Inversión S.A. has complied with the provisions of article 45 of the Regulation of Investment Funds and their Management Companies, approved by SMV Resolution No. 029-2014-SMV/01 and its amendments; as well as with the provisions of the Single Text of Administrative Procedures of the Superintendency of the Market in Securities, approved by Superintendent Resolution No. 023-2015-SMV/02, for the registration of the amendment to the FUND's participation regulations in the RPMV, as developed in Report No. 224-2024-SMV/10.2 dated 22 February 2024; and,

In accordance with the provisions of article 1, subsection b), of the Single Concorded Text of the Organic Law of the Superintendency of the Market in Securities, approved by Decree Law No. 26126, and its amending norms; and article 38, numeral 6) of the Regulation of Organization and Functions of the Superintendency of the Market in Securities, approved by Supreme Decree No. 216-2011-EF and its amendments;

RESOLVES:

Article 1.- To order the registration of the amendment to the Participation Regulations of the investment fund named "Fondo de Inversión en Rentas de Bienes Inmuebles (FIRBI) – AC Capitales Renta", in the corresponding section of the Public Registry of the Securities Market.

Article 2.- AC Capitales Sociedad Administradora de Fondos de Inversión S.A. must send to the Public Registry of the Securities Market one (01) copy of the amended Participation Regulations with the effective date and duly signed by the persons indicated in Annex G, subsection a) numeral 3 of the Regulation of Investment Funds and their Management Companies, within fifteen (15) days following the communication of registration by the Superintendency of the Market in Securities.

Article 3.- To order the dissemination of this resolution on the Securities Market Portal of the Superintendency of the Market in Securities (www.gob.pe/smv).

Article 4.- To transcribe this resolution to AC Capitales Sociedad Administradora de Fondos de Inversión S.A.
