The General Intendant of Supervision of Entities

WHEREAS:

File No. 2023050381 initiated by Independiente Sociedad Administradora de Fondos Sociedad Anónima Cerrada, as well as Report No. 184-2024-SMV/10.2 dated 13 February 2024, from the General Intendancy of Supervision of Entities of the Superintendency of the Securities Market;

CONSIDERING:

That, by means of writings submitted up to 9 February 2024, Independiente Sociedad Administradora de Fondos Sociedad Anónima Cerrada requested from the Superintendency of the Securities Market the registration of the mutual fund for investment in securities called “Fondo de Fondos Independiente Renta Fija FMIV”, in the corresponding section of the Public Registry of the Securities Market;

That, from the evaluation of the documentation submitted, it has been determined that Independiente Sociedad Administradora de Fondos Sociedad Anónima Cerrada has complied with the provisions of: (i) articles 37, 37-B, 38, 39, 68 and 69 of the Regulation of Mutual Funds for Investment in Securities and their Management Companies, approved by Conasev Resolution No. 068-2010-EF/94.01.1 and its amendments; (ii) Superintendent Resolution No. 155-2018-SMV/02; (iii) the Single Text of Administrative Procedures of the Superintendency of the Securities Market, approved by Superintendent Resolution No. 023-2015-SMV/02, as developed in Report No. 184-2024-SMV/10.2; and,

In accordance with the provisions of article 1, subsection b), of the Single Concorded Text of the Organic Law of the Superintendency of the Securities Market, approved by Law Decree No. 26126 and its amending norms; as well as article 38, numerals 6) and 7) of the Regulation of Organization and Functions of the Superintendency of the Securities Market, approved by Supreme Decree No. 216-2011-EF and its amendments;

RESOLVES:

Article 1.- To order the registration of the mutual fund for investment in securities called “Fondo de Fondos Independiente Renta Fija FMIV”, its respective simplified prospectus and annex of the participation regulation, in the corresponding section of the Public Registry of the Securities Market.

Article 2.- The registration referred to in article 1 of this resolution does not imply that the Superintendency of the Securities Market recommends the subscription of shares of the aforementioned mutual fund for investment in securities or expresses a favorable opinion on its profitability or quality.

Article 3.- Independiente Sociedad Administradora de Fondos Sociedad Anónima Cerrada must include in the simplified prospectus and annex of the participation regulation referred to in article 1 of this resolution, the number and date of the resolution that orders the registration of these documents.

Article 4.- To order the dissemination of this resolution on the Securities Market Portal of the Superintendency of the Securities Market (www.gob.pe/smv).

Article 5.- To transcribe this resolution to Independiente Sociedad Administradora de Fondos Sociedad Anónima Cerrada and to Banco de Crédito del Perú, in its capacity as custodian.
