Resolution of the General Intendancy of Supervision of Entities

WHEREAS:

File No. 2024034132 initiated by Blum Sociedad Administradora de Fondos S.A., as well as Report No. 1211-2024-SMV/10.2 of 16 September 2024, from the General Intendancy of Supervision of Entities of the Superintendency of the Securities Market;

CONSIDERING:

That, by means of writings submitted up to 13 September 2024, Blum Sociedad Administradora de Fondos S.A. requested from the Superintendency of the Securities Market the registration of the mutual investment fund in securities named “Blum USA 500 Acciones Fondo de Fondos Fondo Mutuo”, in the corresponding section of the Public Registry of the Securities Market;

That, from the evaluation of the documentation submitted, it has been determined that Blum Sociedad Administradora de Fondos S.A. has complied with the provisions of: (i) articles 37, 38, 39, 68 and 69 of the Regulation of Mutual Investment Funds in Securities and their Management Companies, approved by Conasev Resolution No. 068-2010-EF/94.01.1 and its amendments; (ii) Superintendency Resolution No. 155-2018-SMV/02; (iii) the Single Text of Administrative Procedures of the Superintendency of the Securities Market, approved by Superintendency Resolution No. 023-2015-SMV/02, as developed in Report No. 1211-2024-SMV/10.2; and,

That, it is the responsibility of Blum Sociedad Administradora de Fondos S.A. and of the investment committee to comply with the requirements established in literal c) of Annex I of the Regulation of Mutual Investment Funds in Securities and their Management Companies and the other applicable rules, with respect to the investments made by “Blum USA 500 Acciones Fondo de Fondos Fondo Mutuo” in the ETF indicated in its annex of the participation regulation ―as it is an instrument representative of participation issued by a company incorporated outside the national territory―, compliance that must be verified integrally at the time of its acquisition and permanently while it is part of the fund's investments; and, In accordance with the provisions of article 1, subsection b), of the Single Concorded Text of the Organic Law of the Superintendency of the Securities Market, approved by Decree Law No. 26126 and its amending rules; as well as article 38, numerals 6) and 7) of the Regulation of Organization and Functions of the Superintendency of the Securities Market, approved by Supreme Decree No. 216-2011-EF and its amendments;

RESOLVES:

Article 1.- To order the registration of the mutual investment fund in securities named “Blum USA 500 Acciones Fondo de Fondos Fondo Mutuo”, its respective simplified prospectus and annex of the participation regulation, in the corresponding section of the Public Registry of the Securities Market.

Article 2.- The registration referred to in article 1 of this resolution does not imply that the Superintendency of the Securities Market recommends the subscription of shares of the aforementioned mutual investment fund in securities or expresses a favorable opinion on its profitability or quality.

Article 3.- Blum Sociedad Administradora de Fondos S.A. must include in the simplified prospectus and annex of the participation regulation referred to in article 1 of this resolution, the number and date of the resolution that orders the registration of these documents.

Article 4.- To order the dissemination of this resolution on the Securities Market Portal of the Superintendency of the Securities Market (www.gob.pe/smv).

Article 5.- To transcribe this resolution to Blum Sociedad Administradora de Fondos S.A. and to Banco de Crédito del Perú, in its capacity as custodian.
