Resolution of the General Intendancy of Supervision of Entities

The General Intendant of Supervision of Entities

WHEREAS:

File No. 2024027482 initiated by Enfoca Sociedad Administradora de Fondos de Inversión S.A., as well as Report No. 1126-2024-SMV/10.2 dated 28 August 2024 from the General Intendancy of Supervision of Entities of the Superintendency of the Securities Market;

CONSIDERING:

That, by means of Director's Resolution on Autonomous Patrimonies No. 046-2011-EF/94.06.2 dated 21 October 2011, the registration of the investment fund named “Enfoca Capital 1, Fondo de Inversión” (hereinafter, FUND) managed by Enfoca Sociedad Administradora de Fondos de Inversión S.A. was ordered in the corresponding section of the Public Registry of the Securities Market (hereinafter, RPMV);

That, in accordance with the provisions of article 45 of the Regulation of Investment Funds and their Management Companies, approved by SMV Resolution No. 029-2014-SMV/01 and its amendments, it corresponds to the management company to request from the Superintendency of the Securities Market the registration of the amendments to the participation regulation corresponding to the fund under its management;

That, by means of writings submitted up to 26 August 2024, Enfoca Sociedad Administradora de Fondos de Inversión S.A. requested the registration of amendments to the Participation Regulation of the FUND in the RPMV, referring to the term of duration of the FUND;

That, from the evaluation of the documentation submitted, it has been determined that Enfoca Sociedad Administradora de Fondos de Inversión S.A. has complied with the provisions of article 45 of the Regulation of Investment Funds and their Management Companies; as well as with the provisions of the Single Text of Administrative Procedures of the Superintendency of the Securities Market, approved by Superintendent Resolution No. 023-2015-SMV/02, for the registration of amendments to the participation regulation of the FUND in the RPMV, as developed in Report No. 1126-2024-SMV/10.2 dated 28 August 2024; and,

In accordance with the provisions of article 1°, subsection b), of the Single Concorded Text of the Organic Law of the Superintendency of the Securities Market, approved by Decree Law No. 26126, and its amending norms; and article 38°, numeral 6) of the Regulation of Organization and Functions of the Superintendency of the Securities Market, approved by Supreme Decree No. 216-2011-EF and its amendments;

RESOLVES:

Article 1.- To order the registration of amendments to the Participation Regulation of the investment fund named “Enfoca Capital 1, Fondo de Inversión”, in the corresponding section of the Public Registry of the Securities Market.

Article 2.- Enfoca Sociedad Administradora de Fondos de Inversión S.A. must send to the Superintendency of the Securities Market the updated version of the participation regulation with the effective date, within a period no greater than fifteen (15) business days from the notification of this resolution.

Article 3.- Enfoca Sociedad Administradora de Fondos de Inversión S.A. must disseminate the amendments to the participation regulation of the investment fund mentioned in article 1° of this resolution, through any of the information media established in the respective participation regulation, within the fifteen (15) calendar days following the notification of this resolution.

Article 4.- Enfoca Sociedad Administradora de Fondos de Inversión S.A. must send to the participants a summary of the amendments in the following investment statement.

Article 5.- To order the dissemination of this resolution on the Securities Market Portal of the Superintendency of the Securities Market (www.gob.pe/smv).

Article 6.- To transcribe this resolution to Enfoca Sociedad Administradora de Fondos de Inversión S.A.
