RESOLUTION OF THE BOARD OF THE NATIONAL BANK OF THE KYRGYZ REPUBLIC

of December 9, 2015 No. 76/9

On Approving the Regulation "On the Creation and Activities of Microcredit Companies and Microcredit Agencies"

(in the edition of the Resolution of the Board of the National Bank of the Kyrgyz Republic of September 28, 2021 No. 2021-P-33/53-8-(NFQU))

In accordance with Articles 7 and 43 of the Law "On the National Bank of the Kyrgyz Republic", the Board of the National Bank of the Kyrgyz Republic resolves:

1. Approve the Regulation "On the Creation and Activities of Microcredit Companies and Microcredit Agencies" (attached).

2. Recognize as having lost force:

• the Resolution of the Board of the National Bank of the Kyrgyz Republic "On the Regulation "On the Creation and Activities of Microcredit Companies and Microcredit Agencies in the Kyrgyz Republic" of September 11, 2002 No. 37/2;

• the second paragraph of paragraph 2 of the Resolution of the Board of the National Bank of the Kyrgyz Republic "On Certain Regulatory Acts of the National Bank of the Kyrgyz Republic" of June 28, 2006 No. 19/4 and Part I of Changes and Additions to Certain Regulatory Acts of the National Bank of the Kyrgyz Republic;

• the Resolution of the Board of the National Bank of the Kyrgyz Republic "On Making Changes and Additions to the Resolution of the Board of the National Bank of the Kyrgyz Republic "On the Interim Regulation "On the Creation of Microcredit Companies and Microcredit Agencies in the Kyrgyz Republic" No. 37/2 of September 11, 2002" of February 29, 2008 No. 9/1;

• the Resolution of the Board of the National Bank of the Kyrgyz Republic "On Making Changes and Additions to the Resolution of the Board of the National Bank of the Kyrgyz Republic of September 11, 2002 No. 37/2 "On the Regulation "On the Creation of Microcredit Companies and Microcredit Agencies", registered in the Ministry of Justice of the Kyrgyz Republic on October 25, 2002, registration number 135-02" of December 28, 2010 No. 95/5;

• paragraph 20 of the Appendix to the Resolution of the Board of the National Bank of the Kyrgyz Republic "On Making Changes and Additions to Certain Regulatory Legal Acts of the National Bank of the Kyrgyz Republic" of April 25, 2012 No. 18/9;

• the second paragraph of paragraph 1 of the Resolution of the Board of the National Bank of the Kyrgyz Republic "On Making Changes and Additions to Certain Regulatory Legal Acts of the National Bank of the Kyrgyz Republic Regulating the Activities of MFOs" of July 11, 2012 No. 29/5 and paragraph 1 of the Appendix to the Resolution;

• paragraph 1 of Appendix 1 to the Resolution of the Board of the National Bank of the Kyrgyz Republic "On Making Additions to Certain Regulatory Legal Acts of the National Bank of the Kyrgyz Republic Regulating the Activities of Microfinance Organizations" of September 25, 2013 No. 35/17;

• sub-paragraph 1 of paragraph 1 of the Resolution of the Board of the National Bank of the Kyrgyz Republic "On Making Changes and Additions to Certain Regulatory Legal Acts of the National Bank of the Kyrgyz Republic" of December 23, 2013 No. 52/8 and paragraph 1 of the Appendix to the Resolution;

• the fourth paragraph of paragraph 1 of the Resolution of the Board of the National Bank of the Kyrgyz Republic "On Making Changes and Additions to Certain Resolutions of the Board of the National Bank of the Kyrgyz Republic" of December 24, 2014 No. 58/16 and paragraph 1 of Appendix 1 to the Resolution;

• the third paragraph of paragraph 1 of the Resolution of the Board of the National Bank of the Kyrgyz Republic "On Making Changes and Additions to Certain Resolutions of the Board of the National Bank of the Kyrgyz Republic" of October 14, 2015 No. 62/1 and Part II of Changes and Additions to Certain Resolutions of the Board of the National Bank of the Kyrgyz Republic.

3. The Legal Department:

• publish this Resolution on the official website of the National Bank of the Kyrgyz Republic;

• after official publication, send this Resolution to the Ministry of Justice of the Kyrgyz Republic for inclusion in the State Register of Regulatory Legal Acts of the Kyrgyz Republic.

4. This Resolution enters into force on February 10, 2016.

5. The Management of Supervision and Licensing Methodology is to bring this Resolution to the attention of the corresponding structural subdivisions of the National Bank of the Kyrgyz Republic, its regional departments, and the Representation of the National Bank of the Kyrgyz Republic in the Batken Region, as well as to active microcredit companies and microcredit agencies in the Kyrgyz Republic and their associations (associations).

6. Control over the implementation of this Resolution is entrusted to the Deputy Chairman of the National Bank of the Kyrgyz Republic L.Dz.Orozbayeva.
