Banks and organizations must reserve funds in national currency on correspondent accounts at the National Bank of the Republic of Kazakhstan during formation periods, with minimum reserve requirements calculated via daily and monthly reports. Banks must notify the National Bank via the Web Portal about bonds in the third category of liabilities, which require a minimum three-year term and prohibit early redemption or liquidity management use. Non-compliance reclassifies bond liabilities to the first category. The National Post Operator is covered only if state-owned, with calculations starting July 31, 2026. Chapter 1. General Provisions
These Rules on Minimum Reserve Requirements (hereinafter - Rules) are developed in accordance with Part 2 of Article 32 of the Law of the Republic of Kazakhstan "On the National Bank of the Republic of Kazakhstan" and define the structure of liabilities of second-level banks, branches of non-resident banks of the Republic of Kazakhstan (hereinafter - bank), as well as the National Post Operator and other organizations carrying out certain types of banking operations, having the right to accept deposits, open and maintain bank accounts of individuals and/or legal entities and having access to operations of the National Bank of Kazakhstan (hereinafter - organization), accepted for the calculation of minimum reserve requirements, the procedure for calculating minimum reserve requirements, fulfilling minimum reserve requirements, reserving and carrying out control over the fulfillment of minimum reserve requirements.
For the purposes of these Rules, the following terms are used:
minimum reserve requirements - the mandatory volume of funds maintained by a bank or organization in reserve assets during the period of formation of reserve assets;
period for determining minimum reserve requirements (hereinafter - determination period) - the period of time for which the liabilities of a bank or organization accepted for the calculation of minimum reserve requirements and the amount of minimum reserve requirements are calculated;
minimum reserve requirement ratio - a coefficient expressed as a percentage applied to the liabilities of a bank or organization accepted for the calculation of minimum reserve requirements;
schedule of periods - a schedule of determination periods and formation periods for banks and organizations for the current calendar year, which is published on the official Internet resource of the National Bank of the Republic of Kazakhstan no later than the tenth working day of the first month of the current year;
reserve assets - funds of a bank or organization in national currency used to fulfill minimum reserve requirements;
period of formation of reserve assets (hereinafter - formation period) - the period of time during which a bank or organization maintains reserve assets to fulfill minimum reserve requirements.
Chapter 2. Structure of bank liabilities
accepted for the calculation of minimum reserve requirements,
and procedure for calculating minimum reserve requirements of a bank
first category of liabilities; second category of liabilities; third category of liabilities.
Bank liabilities accepted for the calculation of minimum reserve requirements include liabilities for principal debt and remuneration, including overdue debt (if any) on principal debt and remuneration.
The determination period is twenty-eight calendar days, begins on the first Tuesday and ends on the last Monday of the twenty-eight-day determination period.
Minimum reserve requirement ratios are established separately for each category of bank liabilities accepted for the calculation of minimum reserve requirements.
In calculating the volume of minimum reserve requirements, bank liabilities accounted for on balance sheet accounts of the Standard Chart of Accounts in second-level banks, mortgage organizations, the Joint Stock Company "Development Bank of Kazakhstan" and branches of non-resident banks of the Republic of Kazakhstan, approved by the Resolution of the Board of the National Bank of the Republic of Kazakhstan of January 31, 2011 No. 3 "On Approval of the Standard Chart of Accounts in second-level banks, mortgage organizations, the Joint Stock Company "Development Bank of Kazakhstan" and branches of non-resident banks of the Republic of Kazakhstan" (registered in the Registry of State Registration of Regulatory Legal Acts of the Republic of Kazakhstan under No. 6793) (hereinafter - Standard Chart of Accounts) are taken into account.
When determining the volume of minimum reserve requirements for each category of bank liabilities accepted for the calculation of minimum reserve requirements, the average value of the corresponding bank liabilities over the determination period is calculated (arithmetic mean).
The first category of bank liabilities accepted for the calculation of minimum reserve requirements is defined in accordance with Appendix 1 to the Rules.
The second category of bank liabilities accepted for the calculation of minimum reserve requirements is defined in accordance with Appendix 2 to the Rules and paragraph 7-1 of the Rules.
The third category of bank liabilities accepted for the calculation of minimum reserve requirements is defined in accordance with Appendix 3 to the Rules and paragraph 7-3 of the Rules.
7-1. The second category of bank liabilities accepted for the calculation of minimum reserve requirements is determined as the calculated amount of bank liabilities for repurchase agreements taking into account the bank's claims for reverse repurchase agreements and interbank money market operations (hereinafter - calculated amount for repurchase agreements), multiplied by the adjustment coefficient for repurchase agreements, determined in accordance with paragraph 7-2 of the Rules.
The calculated amount for repurchase agreements is determined as the positive difference between the average over the determination period of the sum of the bank's liabilities for repurchase agreements and the sum of the bank's claims for reverse repurchase agreements and interbank money market operations.
7-2. The adjustment coefficient for repurchase agreements in national currency, the value of which is in the interval from 0 to 1 with a precision of 2 (two) decimal places, is determined as the average over the calendar year share of daily open positions of non-bank buyers for repurchase agreements in the total volume of open positions for repurchase agreements carried out in national currency on the Kazakhstan Stock Exchange (hereinafter - KSE). Non-bank buyers for repurchase agreements include all buyers for repurchase agreements except banks and the National Bank of the Republic of Kazakhstan carrying out repurchase agreements on their own behalf and at their own expense.
The adjustment coefficient for repurchase agreements in national currency is calculated by the KSE based on the results of the past calendar year, published on the official Internet resource of the KSE no later than the tenth working day of the first month of the current year and applied during the current year, starting from the first determination period of the current year.
The adjustment coefficient for repurchase agreements in foreign currency is taken equal to 1 (one).
7-3. The third category of bank liabilities accepted for the calculation of minimum reserve requirements includes bank liabilities for bonds issued by the bank, provided that the following conditions are met:
the term of circulation of bonds is at least 3 (three) years;
there is no holder option for early (full) or partial redemption (buyback) of bonds;
bonds are not used for managing client liquidity, including they are not bought back by the issuer at the initiative or request of individual holders;
bonds are not used as an alternative to placing funds of individual clients (for example, in the event of a outflow of large client deposits).
The bank sends a notification to the National Bank of the Republic of Kazakhstan about bonds included in the third category of bank liabilities, in accordance with Appendix 3-1 to the Rules (hereinafter - Notification), which confirms the compliance of the issuance of such bonds with the conditions specified in this paragraph. The Notification is sent via the digital system "Web Portal of the National Bank of the Republic of Kazakhstan".
Bank liabilities for issued bonds are included in the third category of bank liabilities accepted for the calculation of minimum reserve requirements, starting from the determination period following the date of sending the Notification.
In the event of the bank's failure to comply with the condition(s) specified in this paragraph, liabilities for bonds included in the Notification are included in the first category of bank liabilities accepted for the calculation of minimum reserve requirements, starting from the determination period during which such non-compliance is identified.
Minimum reserve requirements for each category of bank liabilities accepted for the calculation of minimum reserve requirements are calculated by multiplying the average value of each category of bank liabilities accepted for the calculation of minimum reserve requirements, the calculation procedure for which is defined in paragraph 7 of the Rules, by the minimum reserve requirement ratio for the corresponding category of liabilities.
Minimum reserve requirements are calculated by summing the indicators of minimum reserve requirements for each category of bank liabilities accepted for the calculation of minimum reserve requirements.
For banks, in the liabilities of which state support funds are accounted for, minimum reserve requirements are increased by an amount equal to 10 (ten) percent of the sum of state support funds to be returned (sum of principal debt without taking into account remuneration as of the last day of the determination period).
For the purposes of these Rules, state support funds mean bank liabilities for deposits, bonds, loans (hereinafter - debt instruments) placed, acquired or provided to the bank before January 1, 2025, using funds of the state budget of the Republic of Kazakhstan, the National Fund of the Republic of Kazakhstan, the National Bank of the Republic of Kazakhstan and/or its subsidiaries to ensure financial stability and/or rehabilitation of the bank, and on which there is income from initial recognition and/or change of liability conditions, including change of interest rate, amount, type and/or term of the debt instrument.
State support funds do not include bank liabilities for debt instruments placed, acquired or provided to the bank using funds of the state budget of the Republic of Kazakhstan, the National Fund of the Republic of Kazakhstan, the National Bank of the Republic of Kazakhstan and/or its subsidiaries, including through quasi-state sector entities, for the purpose of supporting business entities in various sectors of the economy and/or mortgage lending and/or refinancing of mortgage housing loans (mortgage loans).
