WHEREAS:

File No. 2024039908 initiated by Scotia Fondos Sociedad Administradora de Fondos Mutuos S.A., as well as Report No. 1533-2024-SMV/10.2 dated 18 November 2024 from the General Intendancy of Supervision of Entities of the Superintendency of the Market in Securities;

CONSIDERING:

That, by writings submitted up to 15 November 2024, Scotia Fondos Sociedad Administradora de Fondos Mutuos S.A. requested the Superintendency of the Market in Securities to register amendments to the simplified prospectus and annex to the participation regulations of the mutual fund for investment in securities called "SF Inversiones Smart $ II FMIV"; and thereby, the exclusion of the fund from the mutual fund program for investment in securities called "Inversiones Smart $";

That, in addition to the exclusion of the aforementioned fund from the mutual fund program for investment in securities called "Inversiones Smart $", the changes refer to the incorporation, within the fund's investment objective, that the debt instruments in which it invests may be those issued by a company related to Scotia Fondos Sociedad Administradora de Fondos Mutuos S.A., and to clarifications in the wording of the fund's investment strategy;

That, from the evaluation of the documentation submitted, it has been determined that Scotia Fondos Sociedad Administradora de Fondos Mutuos S.A. complies with the provisions of: (i) articles 45-F and 55 of the Regulation of Mutual Funds for Investment in Securities and their Management Companies and its amendments; (ii) the Single Text of Administrative Procedures of the Superintendency of the Market in Securities, approved by Superintendency Resolution No. 023-2015-SMV/02, as developed in Report No. 1533-2024-SMV/10.2; and,

In accordance with the provisions of article 38, numeral 6, of the Regulation of Organization and Functions of the Superintendency of the Market in Securities, approved by Supreme Decree No. 216-2011-EF and its amendments.

RESOLVES:

Article 1.- To approve the registration of the amendments to the simplified prospectus and to the annex to the participation regulations of the mutual fund for investment in securities called "SF Inversiones Smart $ II FMIV" in the corresponding section of the Public Registry of the Securities Market. Likewise, to order the exclusion of the aforementioned mutual fund from the mutual fund program for investment in securities called "Inversiones Smart $".

Article 2.- The amendments to the simplified prospectus and annex to the participation regulations indicated in article 1 above enter into force on 3 December 2024.

Article 3.- To order the dissemination of this resolution on the Securities Market Portal of the Superintendency of the Market in Securities (www.gob.pe/smv).

Article 4.- To transcribe this resolution to Scotia Fondos Sociedad Administradora de Fondos Mutuos S.A. and to Scotiabank Perú S.A.A., in its capacity as custodian.
