CHAPTER I
GENERAL PROVISIONS
Article 1.- Scope
This norm applies to multiple operations companies and specialized companies indicated in letters A and B of article 16 of the General Law of the Financial System and of the Insurance System and Organic Law of the Superintendent of Banks and Insurance - Law No. 26702 and its modifying norms (hereinafter General Law), to the National Bank, to the Agricultural Bank and to the Electronic Money Issuing Companies (EEDE), hereinafter companies, as applicable.
Article 2.- Complementary channels
2.1. For the purposes of this norm, it is considered that, in addition to their public attention offices regulated in the Regulation on Opening, Conversion, Relocation or Closure of Offices, approved by Resolution SBS No. 689-2023 and its modifications, companies may establish as complementary channels for public attention, different from their offices, the following: 1) Correspondent ATMs; 2) Basic Operations Establishments; and 3) Automated Teller Machines.
2.2. In said complementary channels, companies may only carry out the operations and services that they are authorized to perform, under the terms and conditions established in this Regulation.
CHAPTER II
CORRESPONDENT ATMS
Article 3.- Correspondent ATMs
3.1. They are in-person attention points that function in fixed or mobile establishments, managed by an operator, whose purpose is to facilitate companies in providing certain operations and financial services.
3.2. A correspondent ATM operator is considered to be a natural or legal person, different from the companies, that operates the correspondent ATMs.
3.3. An aggregator of correspondent ATM operators is considered to be a legal person that carries out the affiliation and administration of correspondent ATM operators.
3.4. Companies may sign contracts with the operators or with the aggregators of correspondent ATM operators to carry out, through them, the operations and services authorized by this Regulation.
3.5. These contracts do not involve the transfer of use, lease, loan, or usufruct of a space within the establishment conducted by the operator to the companies, nor do they imply the direct performance of activities by the companies. The activity of a correspondent ATM does not imply any modification of the nature and regime of the operator in its main activity.
Article 4.- Responsibilities of the companies
4.1. The Board of Directors must approve the decision to sign contracts with correspondent ATMs, which must be recorded in the corresponding minutes. Such approval is carried out only once for the decision to implement the correspondent ATM channel.
4.2. The Risk Unit must prepare and send to this Superintendency a Risk Report for new products and significant changes, in accordance with the provisions indicated in Circular No. G-165-2012. This report must be prepared and sent prior to the initial implementation of the correspondent ATM channel, as well as for any significant change in its functioning after its implementation, specifying the limits established by the company for the provision of the operations and services offered through said channel. A significant change in the functioning of the correspondent ATM channel after its implementation constitutes, among others, carrying out new operations and services referred to in letter q) of item 5.1 of article 5 of this Regulation or signing agreements with new aggregators.
4.3. Companies must have a business plan for the development and implementation of correspondent ATMs, which must contain as a minimum the following information: the implementation strategy, the operations and services to be provided, limits to be applied if applicable, initial and projected geographic coverage, criteria for the selection of correspondent ATMs and correspondent ATM operators, technological scheme to be used, and other aspects that the company considers relevant. Once the correspondent ATMs are implemented, the business plan must be updated prior to the execution of the significant changes described in item 4.2 of article 4 of this Regulation and be available to this Superintendency when requested.
4.4. The aforementioned limits that the company establishes for the provision of operations and services through the correspondent ATMs must be prudent and related to the cash movement of the operator. These limits must be established per person and per type of transaction, if applicable. In addition, the company must monitor compliance with these limits and other prudential measures established as appropriate.
4.5. Companies maintain responsibility towards the client or user and before this Superintendency for the provision of operations and services, risk management and regulatory compliance related to the operations and services provided through the correspondent ATMs.
4.6. Companies that carry out operations with electronic money through the correspondent ATMs are responsible for adopting the necessary measures to comply with what is established in article 6 of the Regulation of the Law that Regulates the Basic Characteristics of Electronic Money as an Instrument of Financial Inclusion, approved by Supreme Decree No. 090-2013-EF.
4.7. Companies are responsible for compliance with the requirements and conditions applicable to the operators and to the aggregators of correspondent ATM operators, with whom they contract, indicated in this Regulation.
Article 5.- Operations and services
5.1. Through correspondent ATMs, companies may carry out the following operations and services:
a) Collection of credits and other obligations in favor of the companies. b) Allow clients to withdraw money from their accounts. c) Disbursement of consumer and microenterprise credits. d) Payment of Payment Orders. e) Fund transfers. f) Payment of drafts. g) Receive cash deposits, from clients or users, in client accounts. h) Foreign exchange operations in dollars. i) Opening and closing of basic accounts. j) Collection of services and collections in general. k) Receipt of payments to State entities by order of clients or users. l) Payment of remittances sent from abroad. m) Opening and closing of simplified electronic money accounts, with the exception of those corresponding to minors. n) Operations with electronic money, described in the Regulation on Operations with Electronic Money. o) Delivery and activation of supports issued by the issuer for use of simplified electronic money accounts. p) Marketing of microinsurance and mass insurance. q) Other operations and services, with prior authorization of this Superintendency. For this, companies must submit an authorization request addressed to this Superintendency, attaching the risk evaluation report prepared by the Risk Unit. Said report must contain as a minimum the information indicated in the Risk Report for new products and significant changes prepared by the Risk Unit, in accordance with what is established in Circular No. G-165-2012.
5.2. Likewise, within the framework of the general due diligence regime in customer knowledge, and under the responsibility of the companies, through correspondent ATMs they may receive requests from natural persons regarding the opening of demand, time deposit and savings accounts other than basic accounts, as well as requests for consumer and microenterprise credits, which are sent by the correspondent ATM to the company, in accordance with the procedures agreed between both parties.
5.3. Companies may carry out advertising and deliver information that provides guidance on the products and services they offer.
5.4. The operations and services provided through correspondent ATMs must be those that imply automatic credits and/or charges in accounts and/or credit lines, as applicable, without requiring reconciliations or verifications other than those carried out in electronic terminals that are interconnected with the company. In the case of opening basic accounts or simplified electronic money accounts, companies, as applicable, may establish complementary mechanisms as required.
Article 6.- Operability of operators and aggregators
6.1. Operators and aggregators of correspondent ATM operators may operate with several companies.
6.2. Correspondent ATM operators must maintain in the establishments some visible signage to the public, which clearly shows their status as a correspondent ATM operator of the company that operates through them.
Article 7.- Other correspondent ATM modalities
This Superintendency may authorize other correspondent ATM operating modalities with characteristics different from those indicated in article 3 of this Regulation, prior to evaluation of the controls to be applied for adequate management of the associated risks. For this, companies must submit an authorization request addressed to this Superintendency, attaching the following information:

Article 8.- Management of the correspondent ATM channel
Companies that operate and use the correspondent ATM channel must comply with the following:
Compliance with the requirements defined by the company for the selection of operators and aggregators of correspondent ATM operators must be monitored periodically.
Companies must establish in the contract the responsibilities assumed by the natural or legal persons who operate the correspondent ATM.
Provide to the natural or legal persons who operate the correspondent ATMs the operational manuals that are necessary for the adequate provision of operations and services to clients or users; which must include the established limits.
Train the people involved in the operation of the correspondent ATMs to adequately provide the agreed operations and services. The training must include, in addition to operational aspects, those aspects related to the adequate identification and attention of clients or users, confidentiality of information and bank secrecy.
Implement measures that control operational risk and money laundering and terrorism financing risks.
Have mechanisms that allow clients or users to adequately identify the correspondent ATM, as well as inform about the operations and services they provide through them.
Maintain an updated register of the operators and aggregators of correspondent ATM operators, as well as of the correspondent ATMs with which they operate, including: identification data of the operator and the aggregator (if applicable), location and exact address of the correspondent ATMs, geographic scope where they operate when mobile, operations and services permitted, among others.
Have adequate means to inform clients or users about the location and exact address, and operations and services that can be carried out through the correspondent ATMs. As a minimum, they must publish this information on their website and keep it continuously updated, to facilitate the identification of the authorized correspondent ATMs through which clients or users can carry out their operations and services.
Develop correspondent ATM knowledge procedures in their capacity as providers of the companies, for which the provisions of article 36 of the Regulation on Money Laundering and Terrorism Financing Risk Management must be taken into account.
