Resolution SBS No. 3362-2017: Substitute Paragraph of Article 4 of the Procedures for the Registration of Credit Information Reported in the Co-borrower Report and of Rectifications of Complementary Information, Approved by Res. SBS No. 6413-2014

CONSIDERING:

That, by means of SBS Resolution No. 6413-2014 of September 26, 2014, the Procedures for the Registration of Credit Information Reported in the Co-borrower Report and of Rectifications of Complementary Information were approved;

That, by means of SBS Resolution No. 4174-2015 of July 15, 2015, the Regulation of Group Solidary Credits was approved;

That, subsequently, by means of SBS Resolution No. 2170-2016 of April 13, 2016, the deadline for the implementation of the Co-borrower Report as well as for the transmission of information on group solidary credits was modified;

That, it has been deemed convenient to grant a longer deadline for the implementation of the Co-borrower Report as well as for the transmission of information on group solidary credits in said report, with the aim of allowing greater identification of co-borrower credits and granting greater facilities to the adaptation process;

With the approval of the Adjunct Superintendencies of Banking and Microfinance, Risks, Economic Studies and Legal Advice; and,

In exercise of the powers conferred by numbers 7 and 13 of article 349 of the General Law of the Financial System and of the Insurance System and Organic Law of the Superintendence of Banking and Insurance, Law No. 26702 and its amendments; and, based on the exceptional conditions established in article 14 of Supreme Decree No. 001-2009-JUS;

RESOLVES:

Article First.- Substitute the first paragraph of article 4 of the Procedures for the Registration of Credit Information Reported in the Co-borrower Report and of Rectifications of Complementary Information, approved by SBS Resolution No. 6413-2014 and its modifying norms, with the following:

“Article 4.- Deadlines

Companies must send the new reports, as indicated below:

Report Frequency Deadline First submission to the Risk Central Co-borrower Report (RCCOD) Monthly Up to 15 calendar days following the closing of the period, together with the RCD The first reporting period corresponds to the close information of May 2019 (…)”

Article Second.- Regarding the Report of Rectifications of Complementary Information (RIC) referred to in the Procedures for the Registration of Credit Information Reported in the Co-borrower Report and of Rectifications of Complementary Information, approved by SBS Resolution No. 6413-2014 and its modifying norms, the co-borrower information may be sent starting from the publication of the consolidated data at the close of May 2019.

Article Third.- This resolution enters into force from the day following its publication in the Official Gazette El Peruano.
