CFTC Staff Letter 01-31: Interpretation of Rule 1.25(c)(5) Redemption Requirements for Money Market Mutual Funds

The Division of Trading and Markets will raise no issue regarding a futures commission merchant's or clearing organization's compliance with Commission Rule 1.25(c)(5) if their invested money market mutual fund allows redemption delays under specific extraordinary circumstances. These permitted exceptions include non-routine closures of the Fedwire or New York Stock Exchange, broad restrictions on NYSE trading due to market-wide events, or a declaration of a market emergency by the Securities and Exchange Commission. The Division also accepts references to Section 22(e) of the Investment Company Act of 1940 as defining these emergency conditions. This no-action stance does not preclude the Commission from examining such investments if particular circumstances warrant review.
