Alternative Net Capital Requirements for Broker-Dealers That Are Part of Consolidated Supervised Entities

The Securities and Exchange Commission proposes amendments to Rules 15c3-1, 15c3-4, 17a-5, 17a-11, 17h-1T, and 17h-2T to establish a voluntary alternative method for computing net capital for broker-dealers with tentative net capital of at least $1 billion and net capital of at least $500 million. Eligible broker-dealers affiliated with a consolidated supervised entity may use internal mathematical models, including value-at-risk models, to calculate market and credit risk charges instead of the standard net capital rule. This exemption requires the holding company to maintain a group-wide internal risk management control system, consent to group-wide Commission supervision, and submit periodic reports consistent with Basel Standards.
