The FDIC is amending its Guidelines for Appeals of Material Supervisory Determinations by replacing the current Supervision Appeals Review Committee with an independent Office of Supervisory Appeals. This Office will serve as the final level of review for material supervisory determinations made by the FDIC, operating independently and making determinations without deferring to either party's judgments. Additionally, appeal rights for FDIC-supervised financial institutions will be expanded to include certain cases where an enforcement action is proposed or pending. The FDIC will notify institutions when the Office becomes operational.
