BCB Resolution No. 317: Sets Maximum Deadlines for Administrative Decisions on Economic Activity Release Requests and Classifies Risk Levels

RESOLUTION
BCB NO. 317, OF APRIL 27, 2023

Sets the maximum deadlines for the administrative decision of requests for public acts of release of economic activity required from the Central Bank of Brazil and classifies the risk levels related to such release, in accordance with the provisions of Decree No. 10,178, of December 18, 2019, which regulates Law No. 13,874, of September 20, 2019, and revokes Ordinances Nos. 108,302, of September 17 of 2020, and 110,741, of June 24, 2021.

The Collegiate Board of Directors of the Central Bank of Brazil, in a session held on April 26, 2023, based on arts. 3, § 1, and 10 of Decree No. 10,178, of December 18, 2019, with the changes introduced by Decree No. 10,219, of January 30 2020,

R E S O L V E S:

Art.

This Resolution establishes:

I - the maximum deadlines for administrative decision of requests for public acts of release of economic activity submitted to the Central Bank of Brazil; and

II - the classification of risk levels inherent to the release of economic activity.

Art.
2. This Resolution does not apply to requests for public acts of release of the
economic activity regarding:

I - to Law No. 4,595, of December 31, 1964;

II - to Complementary Law No. 130, of April 17, 2009;

III

to other matters whose regulation is reserved for complementary law.

Art.
3. The Central Bank of Brazil may establish, in accordance with art. 10, § 4,
of Decree No. 10,178, of December 18, 2019, specific deadlines for different phases of the administrative process for the release of economic activity, which will not exceed the maximum deadlines indicated in the table attached to this Resolution.

Sole paragraph. The specific deadlines referred to in the main text shall be subject to communication to the applicants, in the form of art. 12, § 1, of Decree No. 10,178, of 2019.

4. Acts of release of economic activity subject to the incidence of Law No.
13,874, of September 20, 2019, and its regulation, not provided for in the annexed tables to this Resolution:

I - will observe the maximum deadline of sixty days for administrative decision;

II - will receive the treatment of the high risk level (Risk III).

Art. 5. Ordinances Nos. 108,302, of September 17 of 2020, and 110,741, of June 24, 2021, are revoked.

6. This Resolution enters into force on the date of its publication.
