CFTC Letter 02-89: No-Action Position on CPO and CTA Registration for State-Regulated Insurance Company Separate Accounts

The Division of Trading and Markets will not recommend enforcement action against a state-regulated insurance company for failing to register as a commodity pool operator or commodity trading advisor when operating separate accounts for specific life insurance products. This relief applies provided that investment management is performed by a registered CTA and all commodity pools in which the accounts invest are operated by registered CPOs. The insurance company must continue to comply with all other applicable Act provisions, including antifraud rules and reporting requirements, and must notify the Division of any changes to the represented facts.
