CFTC Staff Advisory No. 16-60: Compliance with Suspicious Activity Reporting and OFAC Sanctions

Futures commission merchants and introducing brokers must file suspicious activity reports with the Financial Crimes Enforcement Network for transactions involving at least $5,000 where they know, suspect, or have reason to suspect illegal activity, evasion of the Bank Secrecy Act, lack of lawful purpose, or facilitation of criminal activity. These reports must be filed within 30 calendar days of initial detection, with a possible 30-day extension to identify a suspect, but never exceeding 60 days. Additionally, all registered persons must regularly screen customers against the Office of Foreign Assets Control Specially Designated Nationals list and sanctions programs to ensure compliance with economic sanctions.
